PAG LIN 1 1 Section 1. Section 718.6, Code 1995, is amended to read as 1 2 follows: 1 3 718.6 FALSE REPORTS TOLAW ENFORCEMENT AUTHORITIESOR 1 4 COMMUNICATIONS WITH PUBLIC SAFETY ENTITIES. 1 5 1. A person who reports or causes to be reported false 1 6 information to a fire department,ora law enforcement 1 7 authority, or other public safety entity, knowing that the 1 8 information is false, or who reports the alleged occurrence of 1 9 a criminal act knowing thesameact did not occur, commits a 1 10 simple misdemeanor, unless the alleged criminal act reported 1 11 is a serious or aggravated misdemeanor or felony, in which 1 12 case the person commits a serious misdemeanor. 1 13 2. A person who telephones an emergency 911 communications 1 14 center and terminates the call without providing emergency 1 15 information or telephones an emergency 911 communications 1 16 center knowing that the person is not reporting an emergency 1 17 or otherwise needing emergency information or assistance 1 18 commits a simple misdemeanor. 1 19 3. A person who provides false information on a citation 1 20 commits a simple misdemeanor, unless the criminal act for 1 21 which the citation is issued is a serious or aggravated 1 22 misdemeanor or felony, in which case the person commits a 1 23 serious misdemeanor. 1 24 Sec. 2. EFFECTIVE DATE. This Act shall not take effect 1 25 unless an appropriation is enacted or the state's share of the 1 26 cost is specified in accordance with section 25B.2, subsection 1 27 3. 1 28 EXPLANATION 1 29 This bill provides that a person who makes a false report 1 30 to a fire department, law enforcement agency, or other public 1 31 safety entity commits a serious misdemeanor if the false 1 32 criminal act reported is a serious or aggravated misdemeanor 1 33 or felony. The bill also makes it a simple misdemeanor for a 1 34 person to call an E911 communications center and hang up or to 1 35 call knowingly not having an emergency. The bill also 2 1 provides that a person providing false information on a 2 2 citation commits a simple misdemeanor unless the citation is 2 3 for a serious or aggravated misdemeanor or felony, in which 2 4 case, the penalty is a serious misdemeanor. 2 5 The bill may provide a state mandate under chapter 25B and 2 6 shall not take effect unless an appropriation is made fully 2 7 funding the cost to political subdivisions of implementing 2 8 this bill or specifying the state's share of the cost. 2 9 LSB 1707SS 76 2 10 mk/sc/14.1
