1 1 Section 1. Section 455B.171, Code 1995, is amended by
1 2 adding the following new subsections:
1 3 NEW SUBSECTION. 1B. "Animal unit" means a unit of
1 4 measurement used to determine the animal capacity of a
1 5 confinement feeding operation, based upon the product of
1 6 multiplying the number of animals of each species by the
1 7 following:
1 8 a. Slaughter and feeder cattle 1.0
1 9 b. Mature dairy cattle 1.4
1 10 c. Butcher and breeding swine, over fifty-five pounds 0.4
1 11 d. Sheep or lambs 0.1
1 12 e. Horses 2.0
1 13 f. Turkeys 0.018
1 14 g. Broiler or layer chickens 0.01
1 15 NEW SUBSECTION. 1C. "Confinement feeding operation" means
1 16 an area which is totally roofed in which animals are confined
1 17 and fed and maintained for forty-five days or more in any
1 18 twelve-month period. Two or more operations under common
1 19 ownership or management are deemed to be a single confinement
1 20 feeding operation if they are adjacent or utilize a common
1 21 area or system for manure disposal.
1 22 NEW SUBSECTION. 7A. "Manure" means animal excreta or
1 23 other commonly associated wastes of animals, including but not
1 24 limited to bedding, litter, or feed losses.
1 25 Sec. 2. Section 455B.173, Code 1995, is amended by adding
1 26 the following new subsection:
1 27 NEW SUBSECTION. 12. Adopt rules for the treatment of
1 28 manure from confinement feeding operations having a capacity
1 29 of two thousand five hundred or more animal units. The rules
1 30 shall not apply to operations which produce manure on a dry
1 31 matter basis. The rules shall, to every extent practical,
1 32 incorporate current and generally accepted methods and
1 33 techniques for the treatment and stabilization of sewage
1 34 originating from human populations. The type and degree of
1 35 treatment technology required to be installed shall be based
2 1 on the size of the operation. The rules shall require that a
2 2 confinement feeding operation subject to this subsection, and
2 3 constructed on or after the effective date of this Act, be
2 4 required to install a treatment system employing bacterial
2 5 action which is maintained by the utilization of air or
2 6 oxygen, and which shall include aeration equipment. The
2 7 equipment shall be installed, operated, and maintained in
2 8 accordance with the manufacturer's instructions and the
2 9 requirements of rules adopted pursuant to this subsection.
2 10 EXPLANATION
2 11 This bill requires the environmental protection commission
2 12 to adopt rules for the treatment of manure from confinement
2 13 feeding operations having a capacity of 2,500 or more animal
2 14 units. The bill provides that a confinement feeding operation
2 15 is an area which is totally roofed in which animals are
2 16 confined and fed and maintained for 45 days or more in any 12-
2 17 month period. An animal unit is a measurement used to
2 18 determine the animal capacity of a confinement feeding
2 19 operation, based upon the weight of different animal species.
2 20 The bill provides that the rules do not apply to operations
2 21 which produce manure on a dry matter basis. According to the
2 22 bill, the rules must, to every extent practical, incorporate
2 23 current and generally accepted methods and techniques for the
2 24 treatment and stabilization of sewage originating from human
2 25 populations. The bill requires that the type and degree of
2 26 treatment technology required to be installed must be based on
2 27 the size of the operation. The bill provides that a
2 28 confinement feeding operation, constructed on or after the
2 29 effective date of the bill, must be required to install a
2 30 treatment system employing bacterial action which is
2 31 maintained by the utilization of air or oxygen, and which must
2 32 include aeration equipment. The bill provides that the
2 33 equipment must be installed, operated, and maintained in
2 34 accordance with the manufacturer's instructions and the rules
2 35 of the commission.
