  1  1    Section 1.  Section 70A.20, subsection 1, Code 1995, is
  1  2 amended to read as follows:
  1  3    1.  Waiting period, ninety working days of continuous
  1  4 sickness or accident disability or the expiration of accrued
  1  5 sick leave, whichever is greater less.
  1  6    Sec. 2.  Section 70A.20, subsection 4, Code 1995, is
  1  7 amended to read as follows:
  1  8    4.  All permanent full-time state employees shall be
  1  9 covered under the employees disability insurance program,
  1 10 except board members and members of commissions who are not
  1 11 full-time state employees, and state employees who on July 1,
  1 12 1974, are under another disability program financed in whole
  1 13 or in part by the state, and state employees who have agreed
  1 14 to participation in another disability program through a
  1 15 collective bargaining agreement.  For purposes of this
  1 16 section, members of the general assembly serving on or after
  1 17 January 1, 1989, are eligible for the plan during their tenure
  1 18 in office, on the basis of enrollment rules established for
  1 19 full-time state employees excluded from collective bargaining
  1 20 as provided in chapter 20.  
  1 21                           EXPLANATION
  1 22    This bill provides that the waiting period for receiving
  1 23 benefits under the state employees disability insurance
  1 24 program is the lesser of 90 days or the amount of the
  1 25 employee's accrued sick leave.  Current law provides that the
  1 26 waiting period is the greater of 90 days or accrued sick
  1 27 leave.
  1 28    This bill also provides that state employees can, through
  1 29 collective bargaining, agree to a different disability program
  1 30 than the program established under section 70A.20.
