PAG LIN 1 1 Section 1. Section 257.2, subsection 12, Code 1995, is 1 2 amended to read as follows: 1 3 12. "State percent of growth" means the percent of growth 1 4 which is establishedby statutepursuant to section 257.8, and 1 5 which is used in determining the allowable growth. 1 6 Sec. 2. Section 257.8, subsection 1, Code 1995, is amended 1 7 to read as follows: 1 8 1. STATE PERCENT OF GROWTH. The state percent of growth 1 9 for a budget year shall be established by statute which shall 1 10 be enacted within thirty days of the submission in the base 1 11 year of the governor's budget under section 8.21. The 1 12 establishment of the state percent of growth for a budget year 1 13 shall be the only subject matter of the bill which enacts the 1 14 state percent of growth for a budget year. However, if a 1 15 statute to establish the state percent of growth is not 1 16 enacted within the required thirty-day period, the state 1 17 percent of growth is set at the percent, but not less than 1 18 zero, by which the revenue estimating conference estimated, at 1 19 its previous December meeting, the revenues to the general 1 20 fund of the state will increase during the budget year over 1 21 the base year. 1 22 Sec. 3. This Act, being deemed of immediate importance, 1 23 takes effect upon enactment and applies to the establishing of 1 24 the state percent of growth for school budget years beginning 1 25 after the effective date of this Act. 1 26 EXPLANATION 1 27 Present law requires that within 30 days of the governor's 1 28 submission of the budget to the general assembly, a statute 1 29 must be enacted that establishes the state percent of growth 1 30 for the school budget year beginning the following July 1. 1 31 This bill provides that if the statute is not enacted within 1 32 the 30-day period, the state percent of growth will 1 33 automatically be set at the revenue estimating conference's 1 34 estimated percent of increase in state revenues for the coming 1 35 year over the existing year. 2 1 The bill takes effect upon enactment and applies to budget 2 2 years beginning after the effective date. 2 3 LSB 2284XS 76 2 4 mg/jw/5
