  1  1    Section 1.  Section 331.904, subsection 2, Code 1995, is
  1  2 amended to read as follows:
  1  3    2.  Each deputy sheriff shall receive an annual base salary
  1  4 as determined by the board sheriff.  Upon certification by the
  1  5 sheriff, if the salary of each deputy does not exceed the
  1  6 limitations specified in this subsection, the board shall
  1  7 review, and may modify, certify the annual base salary of each
  1  8 deputy before certifying it to the auditor.  The annual base
  1  9 salary of a first or second deputy sheriff shall not exceed
  1 10 eighty-five percent of the annual base salary of the sheriff.
  1 11 The annual base salary of any other deputy sheriff shall not
  1 12 exceed the annual base salary of the first or second deputy
  1 13 sheriff except that in counties over two hundred fifty
  1 14 thousand population, the annual base salary of any additional
  1 15 deputies shall not exceed seventy-five percent of the annual
  1 16 base salary of the sheriff.  The board shall not certify a
  1 17 deputy's salary which exceeds the limitations of this
  1 18 subsection.  As used in this subsection, "base salary" means
  1 19 the basic compensation excluding overtime pay, longevity pay,
  1 20 shift differential pay, or other supplemental pay and fringe
  1 21 benefits.  
  1 22                           EXPLANATION
  1 23    This bill provides that the annual base salary of each
  1 24 deputy sheriff shall be determined by the sheriff within the
  1 25 limitations specified by law.  Currently, the board of
  1 26 supervisors determines the annual base salaries of the deputy
  1 27 sheriffs.  However, the annual salaries of deputy auditors,
  1 28 treasurers, and recorders are determined by their principal
  1 29 officers.
