PAG LIN 1 1 Section 1. Section 216B.3, subsection 14, Code 1995, is 1 2 amended to read as follows: 1 3 14. In conjunction with the recommendations made by the 1 4 department of natural resources, purchase and use recycled 1 5 printing and writing paper in accordance with the schedule 1 6 established in section 18.18; establish a wastepaper recycling 1 7 program, by January 1, 1990, in accordance with the 1 8 recommendations made by the department of natural resources 1 9 and requirements of section 18.20;comply with the recycling1 10goal, recycling schedule, and ultimate termination of purchase1 11and use of polystyrene products for the purpose of storing,1 12packaging, or serving food for immediate consumption pursuant1 13to section 455D.16;and, in accordance with section 18.6, 1 14 require product content statements, the provision of 1 15 information regarding on-site review of waste management in 1 16 product bidding and contract procedures, and compliance with 1 17 requirements regarding contract bidding. 1 18 Sec. 2. Section 262.9, subsection 5, Code 1995, is amended 1 19 to read as follows: 1 20 5. In conjunction with the recommendations made by the 1 21 department of natural resources, purchase and use recycled 1 22 printing and writing paper, with the exception of specialized 1 23 paper when no recyclable product is available, in accordance 1 24 with the schedule established in section 18.18; establish a 1 25 wastepaper recycling program for all institutions governed by 1 26 the board in accordance with recommendations made by the 1 27 department of natural resources and the requirements of 1 28 section 18.20;comply with, and the institutions governed by1 29the board shall also comply with, the recycling goal,1 30recycling schedule, and ultimate termination of purchase and1 31use of polystyrene products for the purpose of storing,1 32packaging, or serving food for immediate consumption pursuant1 33to section 455D.16;shall, in accordance with the requirements 1 34 of section 18.6, require product content statements, the 1 35 provision of information regarding on-site review of waste 2 1 management in product bidding and contract procedures, and 2 2 compliance with requirements regarding procurement 2 3 specifications; and shall comply with the requirements for the 2 4 purchase of lubricating oils and industrial oils as 2 5 established pursuant to section 18.22. 2 6 Sec. 3. Section 307.21, subsection 4, paragraph b, 2 7 subparagraph (3), Code 1995, is amended by striking the 2 8 subparagraph. 2 9 Sec. 4. Section 455D.5, subsection 3, Code 1995, is 2 10 amended by striking the subsection. 2 11 Sec. 5. REPEALS. Section 18.21 and section 455D.16, Code 2 12 1995, are repealed. 2 13 Sec. 6. EFFECTIVE DATE. This Act, being deemed of 2 14 immediate importance, takes effect upon enactment. 2 15 EXPLANATION 2 16 This bill eliminates the existing ban on the manufacture, 2 17 offer for sale, sale, or use of any polystyrene packaging 2 18 products or food service items in this state.
