PAG LIN 1 1 Section 1. Section 237A.5, subsection 2, paragraph a, Code 1 2 1995, is amended to read as follows: 1 3 a. If a person is being considered for licensure or 1 4 registration under this chapter, or for employment involving 1 5 direct responsibility for a child or with access to a child 1 6 when the child is alone, by a child day care facility subject 1 7 to licensure or registration under this chapter, or if a 1 8 person will reside in a facility, and if the person has been 1 9 convicted of a crime or has a record of founded child abuse, 1 10 the department and the licensee or registrant for an employee 1 11 of the licensee or registrant shall perform an evaluation to 1 12 determine whether the crime or founded child abuse warrants 1 13 prohibition of licensure, registration, employment, or 1 14 residence in the facility. The department shall conduct 1 15 criminal and child abuserecordrecords checks in this state 1 16 and may conduct these checks in other states. In addition the 1 17 department shall comply with federal requirements, including 1 18 but not limited to obtaining fingerprints, as necessary to 1 19 conduct a federal bureau of investigation national criminal 1 20 records check. Any federal charges for the cost of performing 1 21 the national criminal records check shall be paid by the 1 22 individual who is the subject of the check. The evaluation 1 23 shall be performed in accordance with procedures adopted for 1 24 this purpose by the department. 1 25 EXPLANATION 1 26 This bill requires the department of human services to 1 27 conduct a federal bureau of investigation national criminal 1 28 records check of personnel of registered or licensed child day 1 29 care providers. The department is directed to comply with 1 30 federal requirements as necessary to conduct the records 1 31 checks, including obtaining fingerprints.
