1 1 Section 1. NEW SECTION. 70A.26 DISASTER SERVICE
1 2 VOLUNTEER LEAVE.
1 3 An employee of an appointing authority who is a certified
1 4 disaster service volunteer of the American red cross may be
1 5 granted leave with pay from work for not more than fifteen
1 6 working days in any twelve-month period to participate in
1 7 disaster relief services for the American red cross at the
1 8 request of the American red cross for the services of that
1 9 employee and upon the approval of the employee's appointing
1 10 authority without loss of seniority, pay, vacation time,
1 11 personal days, sick leave, insurance and health coverage
1 12 benefits, or earned overtime accumulation. The appointing
1 13 authority shall compensate an employee granted leave under
1 14 this section at the employee's regular rate of pay for those
1 15 regular work hours during which the employee is absent from
1 16 work. An employee deemed to be on leave under this section
1 17 shall not be deemed to be an employee of the state for
1 18 purposes of workers' compensation. An employee deemed to be
1 19 on leave under this section shall not be deemed to be an
1 20 employee of the state for purposes of the Iowa tort claims
1 21 Act. Leave under this section shall be granted only for
1 22 services relating to a disaster in the state of Iowa.
