PAG LIN 1 1 Section 1. Section 730.5, subsection 3, paragraph a, Code 1 2 1995, is amended to read as follows: 1 3 a. The employer has probable cause to believe that an 1 4 employee's faculties are impaired on the job.or the employer 1 5 is investigating an accident in the workplace and all of the 1 6 following conditions are met: 1 7 (1) The employer has reasonable grounds to believe that 1 8 the employee proposed to be tested either directly caused or 1 9 directly contributed to the accident. 1 10 (2) The surrounding circumstances do not reasonably 1 11 exclude the possibility that the employee was impaired. 1 12 (3) The accident results in a personal injury which 1 13 requires medical treatment away from the workplace or damages 1 14 to property, including equipment, in an amount reasonably 1 15 estimated to exceed one thousand dollars at the time of the 1 16 accident. 1 17 EXPLANATION 1 18 This bill provides that an employer may require an employee 1 19 to submit to a drug test if the employer is investigating an 1 20 accident in the workplace that results in injury to a person 1 21 that requires medical treatment away from the work site or 1 22 results in $1,000 damage so long as certain additional 1 23 requirements are met. In order to drug test the employee, the 1 24 employer must find that the employee caused or contributed to 1 25 the accident and that the circumstances surrounding the 1 26 accident do not rule out the possibility that the employee was 1 27 impaired. 1 28 A violation of the section governing drug testing 1 29 constitutes a simple misdemeanor and can subject the violator 1 30 to a civil suit. 1 31 LSB 1382SS 76 1 32 ec/jw/5
