PAG LIN 1 1 Section 1. Section 189A.2, Code 1995, is amended by adding 1 2 the following new subsection: 1 3 NEW SUBSECTION. 5A. "Farm deer" means an animal belonging 1 4 to the cervidae family and classified as part of the dama 1 5 species of the dama genus, commonly referred to as fallow 1 6 deer; part of the elaphus species of the cervus genus, 1 7 commonly referred to as red deer or elk; or part of the nippon 1 8 species of the cervus genus, commonly referred to as sika. 1 9 However, a farm deer does not include any unmarked free 1 10 ranging elk. 1 11 Sec. 2. Section 189A.2, subsection 14, Code 1995, is 1 12 amended to read as follows: 1 13 14. "Livestock" meansanya live or dead animal which is 1 14 limited to cattle, sheep, swine, goats,horses, mules or other1 15equines, whether live or deadfarm deer, or which is 1 16 classified as an equine including a horse or mule. 1 17 Sec. 3. Section 189A.2, subsection 16, Code 1995, is 1 18 amended to read as follows: 1 19 16. "Meat food product" means any product capable of use 1 20 as human food which is made wholly or in part from any meat or 1 21 other portion of the carcass of any cattle, sheep, swine, or 1 22 goats, excepting products which contain meat or other portions 1 23 of such carcasses only in a relatively small proportion or 1 24 historically have not been considered by consumers as products 1 25 of the meat food industry, and which are exempted from 1 26 definition as a meat food product by the secretary under such 1 27 conditions as the secretary may prescribe to assure that the 1 28 meat or other portions of such carcass contained in such 1 29 product are not adulterated and that such products are not 1 30 represented as meat food products. This term as applied to 1 31 food products of equines or farm deer shall have a meaning 1 32 comparable to that provided in this paragraph with respect to 1 33 cattle, sheep, swine, and goats. 1 34 Sec. 4. Section 189A.18, Code 1995, is amended to read as 1 35 follows: 2 1 189A.18 HUMANE SLAUGHTER PRACTICES. 2 2 Every establishment subject to the provisions of this 2 3 chapter engaged in the slaughter of bovine, porcine, or ovine 2 4 animals or farm deer shall slaughter all such animals in an 2 5 approved humane slaughtering method. For purposes of this 2 6 section an approved humane slaughtering method shall include 2 7 and be limited to slaughter by shooting, electrical shock, 2 8 captive bolt, or use of carbon dioxide gas prior to the animal 2 9 being shackle hoisted, thrown, cast or cut; however, the 2 10 slaughtering, handling or other preparation of livestock in 2 11 accordance with the ritual requirements of the Jewish or any 2 12 other faith that prescribes and requires a method whereby 2 13 slaughter becomes effected by severance of the carotid 2 14 arteries with a sharp instrument is hereby designated and 2 15 approved as a humane method of slaughter under the law. 2 16 Sec. 5. Section 481A.1, subsection 20, paragraph h, Code 2 17 1995, is amended to read as follows: 2 18 h. The Cervidae: such asdeer andelk or deer, other than 2 19 farm deer. As used in this paragraph, "farm deer" means an 2 20 animal belonging to the cervidae family and classified as part 2 21 of the dama species of the dama genus, commonly referred to as 2 22 fallow deer; part of the elaphus species of the cervus genus, 2 23 commonly referred to as red deer or elk; or part of the nippon 2 24 species of the cervus genus, commonly referred to as sika. 2 25 However, a farm deer does not include any unmarked free 2 26 ranging elk. 2 27 Sec. 6. Section 717.1, subsection 2, Code 1995, is amended 2 28 to read as follows: 2 29 2. "Livestock" means an animal belonging to the bovine, 2 30 caprine, equine, ovine, or porcine species; farm deer, as 2 31 defined in section 481A.1; or poultry. 2 32 Sec. 7. The department of agriculture and land stewardship 2 33 shall conduct a study relating to the needs and desirability 2 34 of adopting or enhancing animal health requirements including 2 35 health certificates for farm deer. In conducting the study, 3 1 the department shall solicit comments and participation from 3 2 organizations representing farm deer producers, cattle 3 3 producers, pork producers, sheep producers, and the department 3 4 of natural resources. As used in this section, "farm deer" 3 5 means an animal belonging to the cervidae family and 3 6 classified as part of the dama species of the dama genus, 3 7 commonly referred to as fallow deer; part of the elaphus 3 8 species of the cervus genus, commonly referred to as red deer 3 9 or elk; or part of the nippon species of the cervus genus, 3 10 commonly referred to as sika.
