1 1 Section 1. Section 103A.3, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 15A. "Mobile home park" means a site,
1 4 lot, field, or tract of land under common ownership upon which
1 5 two or more occupied mobile homes, manufactured homes, modular
1 6 homes, or a combination of the homes are harbored, free of
1 7 charge or for revenue purposes, and includes any building,
1 8 structure, tent, vehicle, or enclosure used or intended for
1 9 use as part of the equipment of the park. "Mobile home park"
1 10 also includes a recreational mobile home park. "Mobile home
1 11 park" does not include mobile homes, buildings, tents, or
1 12 other structures temporarily maintained by an individual,
1 13 educational institution, or company on its own premises and
1 14 used exclusively to house its labor or students.
1 15 Sec. 2. NEW SECTION. 103A.26 SEVERE STORM SHELTER
1 16 REQUIRED FOR MOBILE HOME PARKS &endash; PENALTY &endash; APPLICABILITY.
1 17 1. An owner or operator of a mobile home park shall
1 18 provide one or more severe storm shelters to accommodate the
1 19 occupants of the mobile home park. The severe storm shelters
1 20 shall be constructed and maintained at convenient locations
1 21 throughout the park for use of the occupants of the mobile
1 22 home park when a severe storm warning is issued for the park
1 23 area and the expected severity of the storm makes the
1 24 occupancy of a mobile home unsafe.
1 25 2. The commissioner shall adopt rules pursuant to chapter
1 26 17A which are necessary to provide for the construction and
1 27 maintenance of severe storm shelters in mobile home parks.
1 28 3. An owner or operator of a mobile home park shall
1 29 prohibit the location and occupancy of a mobile home in the
1 30 mobile home park unless a severe storm shelter is constructed
1 31 in the mobile home park and available for use by the occupants
1 32 of the mobile home.
1 33 4. An owner or operator of a mobile home park who violates
1 34 subsection 3 is guilty of a serious misdemeanor.
1 35 5. This section applies only to new mobile home parks
2 1 which are established and begin accepting occupancy on or
2 2 after the effective date of this Act.
2 3 EXPLANATION
2 4 This bill requires new mobile home parks, including
2 5 recreational mobile home parks, to provide severe storm
2 6 shelters for use of the occupants of the mobile home park.
2 7 The severe storm shelters are to be conveniently located
2 8 throughout the park and constructed to meet the standards
2 9 adopted by the state building code commissioner.
2 10 The owner or operator of a new mobile home park is required
2 11 to prohibit mobile homes from being placed or occupied in a
2 12 new mobile home park unless sufficient severe storm shelters
2 13 are available to accommodate the occupants. A violation is
2 14 punishable as a serious misdemeanor which may include
2 15 imprisonment up to one year, a fine of at least $250 but not
2 16 more than $1,500, or both fine and imprisonment.
2 17 The bill only applies to new mobile home parks which begin
2 18 operations on or after the effective date of the bill.
