PAG LIN 1 1 Section 1. Section 455B.183A, subsection 2, Code 1995, is 1 2 amended to read as follows: 1 3 2. The commission shall adopt feesas requiredpursuant to 1 4 section 455B.105 for public water supply system permits as 1 5 requiredfor public water supply systems as providedin 1 6 sections 455B.174 and 455B.183. The fees shall be used solely 1 7 for the purpose of providing technical assistance. The 1 8 commission shall adopt annual fees, the revenue from which 1 9 shall not exceed the annual state appropriations made to the 1 10 department for administration of water supply programs. Fees 1 11 paid pursuant to this section shall not be subject to the 1 12 sales or services tax. The fees shall beforbased on each of 1 13 the following: 1 14 a. The construction, installation, or modification of a 1 15 public water supply system. The amount of the fees may be 1 16 based on the type of system being constructed, installed, or 1 17 modified. 1 18 b. The operation of a public water supply system, 1 19 including any part of the system. The fees may be based on 1 20 the type and size of community served by the system.The1 21commission shall adopt a fee schedule. The commission shall1 22calculate all fees in the schedule to produce total revenues1 23equaling four hundred seventy-five thousand dollars for the1 24fiscal year beginning July 1, 1994, and ending June 30, 1995,1 25seven hundred thousand dollars for the fiscal year beginning1 26July 1, 1995, and ending June 30, 1996, nine hundred thousand1 27dollars for the fiscal year beginning July 1, 1996, and ending1 28June 30, 1997, and one million two hundred thousand dollars1 29for each subsequent fiscal year. For the fiscal year1 30beginning July 1, 1994, and ending June 30, 1995, twenty-five1 31thousand dollars shall be deposited in the administration1 32account and four hundred fifty thousand dollars shall be1 33deposited in the public water supply system account. For each1 34subsequent fiscal year, one-half of the fees shall be1 35deposited into the administration account and one-half of the2 1fees shall be deposited into the public water supply system2 2account. By May 1 of each year, the department shall estimate2 3the total revenue expected to be collected from the2 4overpayment of fees, which are all fees in excess of the2 5amount of the total revenues which are expected to be2 6collected under the current fee schedule, and the total2 7revenue expected to be collected from the payment of fees2 8during the next fiscal year. The commission shall adjust the2 9fees if the estimate exceeds the amount of revenue required to2 10be deposited in the fund pursuant to this paragraph.2 11 EXPLANATION 2 12 This bill requires that public water supply system fees for 2 13 permits be used solely for providing technical assistance and 2 14 requires the environmental protection commission to adopt 2 15 annual fees the revenue from which may not exceed annual state 2 16 appropriations made to the department of natural resources for 2 17 administration of water supply programs.
