PAG LIN 1 1 Section 1. Section 455B.133, subsection 8, Code 1995, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. c. Adopt rules for the issuance of a 1 4 single general permit, after notice and opportunity for a 1 5 public hearing. The single general permit shall cover 1 6 numerous sources to the extent that the sources are 1 7 representative of a class of facilities which can be 1 8 identified and conditioned by a single permit. 1 9 Sec. 2. MORATORIUM &endash; GRAIN STORAGE FACILITIES &endash; CLEAN 1 10 AIR OPERATING PERMIT REQUIREMENTS. 1 11 1. Notwithstanding section 455B.133, a moratorium is 1 12 established during which the department of natural resources 1 13 shall not require persons to complete or submit to the 1 14 department any form, application, or information relating to 1 15 the control of emissions of dust or other particulate matter 1 16 in, on, or around facilities used for the storage of grain, to 1 17 the extent that the form, application, or information is 1 18 related to the administration or enforcement of the clean air 1 19 operating permit program as may be delegated to the state 1 20 pursuant to 42 U.S.C. } 7661a through 7661d. 1 21 2. The moratorium shall expire on the date that the state 1 22 is delegated authority by the United States to administer and 1 23 enforce the clean air operating permit program as provided by 1 24 42 U.S.C. } 7661a through 7661d. 1 25 3. During the moratorium period, the department shall 1 26 adopt forms and procedures as required pursuant to chapter 1 27 17A, which ensure that persons involved in the storage of 1 28 grain may conveniently, simply, and inexpensively comply with 1 29 the program requirements administered and enforced by the 1 30 department. The department shall also conduct a statewide 1 31 education project in order to assist persons involved in the 1 32 storage of grain in complying with the requirements, including 1 33 completing and submitting to the department any necessary 1 34 form, application, or information. The department shall 1 35 cooperate with the agribusiness association of Iowa in 2 1 carrying out this subsection. 2 2 A permit shall not be required for the operation of a grain 2 3 elevator for one hundred twenty days following the expiration 2 4 of the moratorium or the date that departmental rules relating 2 5 to the administration or enforcement of the clean air 2 6 operating permit program become effective, whichever occurs 2 7 earlier. 2 8 4. The department shall periodically report progress in 2 9 carrying out this Act to the chairpersons, vice chairpersons, 2 10 and ranking members of the standing committees on agriculture 2 11 of the senate and house of representatives. A report shall be 2 12 made at least once each three months. 2 13 Sec. 3. EFFECTIVE DATE. This Act, being deemed of 2 14 immediate importance, takes effect upon enactment. 2 15 SF 37 2 16 da/cc/26
