1 1 Amend Senate File 2420, as passed by the Senate, as
1 2 follows:
1 3 #1. Page 1, by striking line 22, through page 2,
1 4 line 5, and inserting the following:
1 5 "Sec. . Section 232.52, subsection 2, paragraph
1 6 d, Code Supplement 1995, is amended by adding the
1 7 following new subparagraph:
1 8 NEW SUBPARAGRAPH. (4) The chief juvenile court
1 9 officer or the officer's designee for placement in a
1 10 program under section 232.191, subsection 4. The
1 11 chief juvenile court officer or the officer's designee
1 12 may place a child in group foster care for failure to
1 13 comply with the terms and conditions of the supervised
1 14 community treatment program for up to seventy-two
1 15 hours without notice to the court or for more than
1 16 seventy-two hours if the court is notified of the
1 17 placement within seventy-two hours of placement,
1 18 subject to a hearing before the court on the placement
1 19 within ten days."
1 20 #2. Page 2, line 18, by inserting after the word
1 21 "violation" the following: "by an adult".
1 22 #3. Page 3, line 22, by inserting before the word
1 23 "a" the following: ", if the person is an adult, a
1 24 violation of".
1 25 #4. Page 6, by inserting after line 7 the
1 26 following:
1 27 "Sec. . Section 723A.1, subsection 1, Code
1 28 Supplement 1995, is amended by adding the following
1 29 new paragraph:
1 30 NEW PARAGRAPH. h. Brandishing a dangerous weapon.
1 31 For purposes of this paragraph:
1 32 (1) "Brandishing a dangerous weapon" means the
1 33 display or exhibition of a dangerous weapon, with the
1 34 intent to intimidate or threaten another person, or
1 35 the actual use of the dangerous weapon in a manner
1 36 which is intended to or does cause serious injury or
1 37 death.
1 38 (2) "Dangerous weapon" means either of the
1 39 following:
1 40 (a) An instrument or device designed primarily for
1 41 use in inflicting death or injury upon a human being
1 42 or animal, and that is capable of inflicting death
1 43 upon a human being when used in the manner for which
1 44 it was designed.
1 45 (b) An instrument or device of any sort whatsoever
1 46 that is actually used in a manner that indicates the
1 47 defendant intends to inflict death or serious injury
1 48 upon another person, and that, when so used, is
1 49 capable of inflicting death or serious injury upon a
1 50 human being."
2 1 #5. Title page, line 1, by inserting after the
2 2 word "including" the following: "the use of deadly
2 3 force by criminal street gangs,".
2 4 #6. By renumbering, relettering, or redesignating
2 5 and correcting internal references as necessary.
