  1  1    Amend Senate File 2370 as follows:
  1  2    #1.  Page 4, line 9, by striking the word "may" and
  1  3 inserting the following:  "shall".
  1  4    #2.  Page 4, line 17, by inserting after the word
  1  5 "implementation" the following:  "and shall not allow
  1  6 the utility to recover future costs at a level other
  1  7 than what the board determines to be reasonable and
  1  8 prudent.  If the result of a contested case proceeding
  1  9 is a judgment against a utility, that utility's future
  1 10 level of cost recovery shall be reduced by the amount
  1 11 by which the programs were found to be imprudently
  1 12 conducted".
