  1  1    Amend Senate File 2389 as follows:
  1  2    #1.  Page 2, by inserting after line 7 the
  1  3 following:
  1  4    "Sec. 101.  EFFECTIVE DATE – STUDY – CONDITIONAL
  1  5 REPEAL.
  1  6    1.  Section 1 of this Act is effective July 1,
  1  7 1997, unless the commissioner of insurance determines
  1  8 through an independent study that the requirements of
  1  9 this Act will affect less than fifteen percent of the
  1 10 Iowa population who have health care coverage pursuant
  1 11 to all managed care plans, indemnity plans, organized
  1 12 delivery systems, self-insured plans, Medicare,
  1 13 medicaid, and any other types of health care coverage
  1 14 that may be available, or if the commissioner
  1 15 determines that as a result of this Act the persons or
  1 16 business entities affected by it will suffer increased
  1 17 health care coverage costs.
  1 18    2.  The commissioner of insurance shall conduct an
  1 19 independent study of health care coverage in this
  1 20 state for the purpose of making a determination under
  1 21 subsection 1.  The commissioner of insurance shall
  1 22 contract with at least two independent actuarial firms
  1 23 or consulting organizations capable of conducting this
  1 24 study required.  The study shall be completed no later
  1 25 than June 1, 1997, and the results of the study shall
  1 26 be certified by the commissioner of insurance to the
  1 27 governor and the secretary of state no later than June
  1 28 15, 1997.
  1 29    3.  If the commissioner determines as a result of
  1 30 this study that less than fifteen percent of Iowa's
  1 31 population who have health care coverage are affected
  1 32 by this Act, section 1 of this Act is repealed
  1 33 effective July 1, 1997.  If the commissioner
  1 34 determines as a result of this study that businesses
  1 35 or individuals affected by section 1 of this Act will
  1 36 be subject to increased health care coverage costs as
  1 37 a result of this Act, section 1 of this Act is
  1 38 repealed effective July 1, 1997.
  1 39    Sec. 102.  There is appropriated from the general
  1 40 fund of the state to the division of insurance of the
  1 41 department of commerce for the fiscal period beginning
  1 42 on the effective date of section 101 and this section
  1 43 of this Act, and ending June 30, 1997, the following
  1 44 amount, or so much thereof as is necessary, for the
  1 45 purpose of conducting the study required by section
  1 46 101 of this Act:  
  1 47 .................................................. $    300,000
  1 48    Sec.    .  Sections 101 and 102 of this Act, being
  1 49 deemed of immediate importance, take effect upon
  1 50 enactment."
  2  1    #2.  Title page, line 3, by inserting after the
  2  2 word "physicians" the following:  ", making an
  2  3 appropriation, providing an effective date, and
  2  4 providing for a conditional repeal".
  2  5    #3.  By renumbering as necessary.
