  1  1    Amend Senate File 2433 as follows:
  1  2    #1.  Page 2, by inserting after line 11 the
  1  3 following:
  1  4    "Sec.    .  Section 85.38, subsection 2, Code 1995,
  1  5 is amended by striking the subsection and inserting in
  1  6 lieu thereof the following:
  1  7    2.  LIEN FOR BENEFITS PAID UNDER NONOCCUPATIONAL
  1  8 PLANS.  If an employer denies liability under this
  1  9 chapter, chapter 85A, or chapter 85B, for any medical
  1 10 services received by a disabled employee from a health
  1 11 service provider, and the employee is a beneficiary
  1 12 under either an individual or group plan for
  1 13 nonoccupational illness, injury, or disability, the
  1 14 nonoccupational plan shall not deny payment for the
  1 15 medical services received on the grounds that the
  1 16 illness, injury, or disability is excluded from
  1 17 payment because the condition arose out of and in the
  1 18 course of employment.  A nonoccupational plan which
  1 19 makes payments for an employee's illness, injury, or
  1 20 disability under this subsection shall have a lien, in
  1 21 an amount equal to the payments made by the plan for
  1 22 the medical services received, against any
  1 23 compensation payments which are made under this
  1 24 chapter, chapter 85A, or chapter 85B.  The amount due
  1 25 under the lien shall be deducted from any compensation
  1 26 payments made.  The lien shall be effective when
  1 27 written notice is sent by the plan to the employer by
  1 28 regular mail."
  1 29    #2.  Title page, line 3, by inserting after the
  1 30 word "cases," the following:  "relating to
  1 31 nonoccupational health care plan payments,".
  1 32    #3.  By renumbering as necessary.
