1 1 Amend Senate File 2186 as follows:
1 2 #1. Page 1, by inserting after line 30 the
1 3 following:
1 4 "Sec. . Section 321.52, Code Supplement 1995, is
1 5 amended by adding the following new subsection:
1 6 NEW SUBSECTION. 3A. A damaged motor vehicle
1 7 subject to registration, for which the cost of repair
1 8 exceeds one hundred percent of the fair market value
1 9 of the vehicle, as determined in accordance with rules
1 10 adopted by the department, shall be issued a junking
1 11 certificate which shall state on the face of the
1 12 certificate the following: "100% Damaged". The
1 13 provisions of subsection 3 shall not apply to a one
1 14 hundred percent damaged junking certificate issued
1 15 under this subsection. A motor vehicle which has
1 16 sustained damage of one hundred percent or more shall
1 17 be sold only for parts or scrap to an authorized
1 18 vehicle recycler, as defined in section 321H.2. The
1 19 provisions of this subsection shall apply only to
1 20 motor vehicles which are five model years old or
1 21 less."
1 22 #2. Title page, line 3, by inserting after the
1 23 word "offenses," the following: "requiring issuance
1 24 of one hundred percent damaged junking certificates,".
