  1  1    Amend Senate File 2324 as follows:
  1  2    #1.  Page 10, by inserting after line 14 the
  1  3 following:  
  1  4                      "DIVISION ___
  1  5           OTHER PUBLIC ASSISTANCE PROVISIONS
  1  6    Sec.    .  Section 252.25, unnumbered paragraph 1,
  1  7 Code 1995, is amended to read as follows:
  1  8    The board of supervisors of each county shall
  1  9 provide for the assistance of poor persons lawfully in
  1 10 its the county who are ineligible for, or are in
  1 11 immediate need and are awaiting approval and receipt
  1 12 of, assistance under programs provided by state or
  1 13 federal law, or whose actual needs cannot be fully met
  1 14 by the assistance furnished under those programs.  The
  1 15 county board of supervisors shall establish general
  1 16 rules as its the board's members deem necessary to
  1 17 properly discharge their responsibility under this
  1 18 section.
  1 19    Sec.    .  PUBLIC ASSISTANCE ELIGIBILITY WAIVER.
  1 20    1.  For the purposes of this section, unless the
  1 21 context otherwise requires, "public assistance" means
  1 22 assistance for the following purposes paid for in
  1 23 whole or in part by the federal government in
  1 24 combination with the state or a political subdivision
  1 25 of the state:
  1 26    a.  The family investment program under chapter
  1 27 239.
  1 28    b.  The medical assistance program under chapter
  1 29 249A.
  1 30    c.  Child day care funding.
  1 31    2.  The department of human services shall submit
  1 32 waiver requests to the United States department of
  1 33 health and human services for authorization for the
  1 34 state and political subdivisions of the state to apply
  1 35 an additional eligibility provision to public
  1 36 assistance, if existing eligibility provisions require
  1 37 the recipient to have a dependent child.  The
  1 38 eligibility provision shall require that at the time
  1 39 of the dependent child's birth, at least one of the
  1 40 parents of the child was either a citizen or was
  1 41 lawfully present in the United States.  The department
  1 42 shall report to the general assembly by December 15,
  1 43 1996, as to the status of the request or requests.  If
  1 44 implementation of an approved federal waiver would
  1 45 require a change in a state law, the department shall
  1 46 submit a proposal for amending the state law to the
  1 47 governor and the general assembly."
