1 1 Amend Senate File 2265 as follows:
1 2 #1. Page 1, by striking lines 27 through 29 and
1 3 inserting the following: "granted prior to
1 4 fulfillment of the requirement if any of the following
1 5 applies:
1 6 a. A party demonstrates that the other party
1 7 refuses to participate in the seminar.
1 8 b. A history of domestic abuse, as defined in
1 9 section 236.2, exists. In determining whether a
1 10 history of domestic abuse exists, the court's
1 11 consideration shall include, but is not limited to,
1 12 commencement of an action pursuant to section 236.3,
1 13 the issuance of a protective order against the parent
1 14 or the issuance of a court order or consent agreement
1 15 pursuant to section 236.5, the issuance of an
1 16 emergency order pursuant to section 236.6, the holding
1 17 of the parent in contempt pursuant to section 236.8,
1 18 the response of a peace officer to the scene of
1 19 alleged domestic abuse or the arrest of the parent
1 20 following response to a report of alleged domestic
1 21 abuse, or a conviction for domestic abuse assault
1 22 pursuant to section 708.2A."
