  1  1    Amend the amendment, H-4229, to House File 258, as
  1  2 amended, passed, and reprinted by the House, as
  1  3 follows:
  1  4    #1.  Page 1, by striking lines 13 through 15 and
  1  5 inserting the following:
  1  6    "b.  "Employee" means employee as defined in
  1  7 section 85.61 and includes the employer, and any chief
  1  8 executive officer, president, vice president,
  1  9 supervisor, manager, and officer of the employer."
  1 10    #2.  Page 1, lines 28 and 29, by striking the words
  1 11 and figures "in effect on or before February 16,
  1 12 1995".
  1 13    #3.  Page 1, lines 36 and 37, by striking the words
  1 14 and figures "in effect on or before February 16,
  1 15 1995".
  1 16    #4.  Page 2, by striking lines 7 through 10.
  1 17    #5.  Page 2, line 11, by striking the figure "(3)"
  1 18 and inserting the following:  "(2)".
  1 19    #6.  Page 2, line 14, by striking the word "five"
  1 20 and inserting the following:  "one".
  1 21    #7.  Page 2, line 16, by striking the figure "(4)"
  1 22 and inserting the following:  "(3)".
  1 23    #8.  Page 2, line 29, by inserting after the word
  1 24 "sample." the following:  "The report and information
  1 25 provided the employer may be both qualitative and
  1 26 quantitative but only concerning the presence of
  1 27 alcohol or an illegal controlled substance in any test
  1 28 sample."
  1 29    #9.  By striking page 2, line 32, through page 3,
  1 30 line 12, and inserting the following:  "test."

  1 32 preemployment physical, the" and inserting the

  1 40 conduct a drug test pursuant to this paragraph, the
  1 41 employer shall provide that a preemployment
  1 42 application process which includes a drug test shall
  1 43 be required in the same manner for all job
  1 44 classifications of the employer in which applicants
  1 45 for employment are sought."

  1 47 regularly scheduled physical, the" and inserting the
  1 48 following:  "For a regularly scheduled physical, the

  1 50    #14.  Page 3, line 32, by inserting after the word
  2  1 "scheduled." the following:  "However, in order to
  2  2 conduct a drug test pursuant to this paragraph, the

  2  4 physical which includes a drug test shall be required
  2  5 in the same manner for all classifications of
  2  6 employees of the employer."

  2  8 inserting the following:
  2  9    "c.  An employer may require an employee, as a
  2 10 condition of employment to undergo drug testing, if
  2 11 the employer has provided substance abuse evaluation,
  2 12 and treatment, if recommended by the evaluation, which
  2 13 have been paid for in whole or in part by the employer
  2 14 or its insurance carrier.  The employee may be
  2 15 required to undergo".

  2 21    #18.  Page 4, line 1, by striking the word "twelve"
  2 22 and inserting the following:  "twenty-four".
  2 23    #19.  Page 4, line 5, by striking the word "twelve-
  2 24 month" and inserting the following:  "twenty-four-
  2 25 month".
  2 26    #20.  Page 4, line 11, by striking the word
  2 27 "physical" and inserting the following:  "physical
  2 28 application process".
  2 29    #21.  Page 4, by inserting after line 11 the
  2 30 following:
  2 31    "Sec.    .  Section 730.5, subsection 11, Code
  2 32 1995, is amended by striking the subsection."
  2 33    #22.  Page 4, by striking lines 15 through 43 and
  2 34 inserting the following:  "drug test pursuant to this
  2 35 section shall submit a report annually to the labor
  2 36 division of the department of employment services,
  2 37 documenting the number of drug tests conducted, the
  2 38 results of the tests conducted, and the direct costs
  2 39 associated with the testing."
