1 7 "Sec. 100. NEW SECTION. 13.34 LEGAL SERVICES FOR
1 8 PERSONS IN POVERTY GRANT PROGRAM.
1 9 1. The attorney general shall contract with an
1 10 eligible nonprofit organization to provide legal
1 11 assistance to persons in poverty. The contract shall
1 12 be awarded within thirty days after May 30, 1996. The
1 13 contract may be terminated by the attorney general
1 14 upon written notice and for good cause.
1 15 2. A nonprofit organization must comply with all
1 16 of the following to be eligible for a contract under
1 17 this section:
1 18 a. Be a nonprofit organization incorporated in
1 19 this state.
1 20 b. Employ attorneys admitted to practice before
1 21 the Iowa supreme court and the United States district
1 22 courts.
1 23 c. Have offices throughout this state.
1 24 d. Employ attorneys and staff qualified to address
1 25 legal problems experienced by persons in poverty.
1 26 3. The contracting nonprofit organization shall do
1 27 all of the following:
1 28 a. Offer direct representation of eligible
1 29 individuals in litigation and administrative cases.
1 30 b. Offer technical support to eligible
1 31 individuals.
1 32 c. Utilize, to the fullest extent feasible,
1 33 existing resources of accredited law schools within
1 34 this state to provide consulting assistance to
1 35 attorneys in the practice of law in their
1 36 representation of persons in poverty.
1 37 d. Assist, to the fullest extent feasible,
1 38 accredited law schools within this state in enhancing
1 39 the schools' expertise in the practice of law
1 40 representing persons in poverty so that all attorneys
1 41 within the state will have a resource available to
1 42 provide training and experience in the practice of law
1 43 representing persons in poverty.
1 44 e. Cooperate, to the fullest extent feasible, with
1 45 existing informational and referral networks among
1 46 persons in poverty, providers of assistance to persons
1 47 in poverty, and others concerned with assistance to
1 48 persons in poverty.
1 49 4. The contracting nonprofit organization is not a
1 50 state agency for the purposes of chapters 19A, 20, and
2 1 669.
2 2 5. An individual is eligible to obtain legal
2 3 representation and legal assistance from the
2 4 contracting nonprofit organization if the individual
2 5 meets all of the following criteria:
2 6 a. The individual is a resident of this state.
2 7 b. The individual is financially unable to acquire
2 8 legal assistance."
2 9 #3. Page 5, line 28, by inserting after the figure
2 10 "13A," the following: "shall transmit the next seven
2 11 hundred thousand dollars to the office of the attorney
2 12 general to be used to implement the contract to
2 13 provide legal services to persons in poverty in
2 14 accordance with section 13.34,".
