1 1 Amend Senate File 2101 as follows:
1 2 #1. Page 1, by inserting after line 24 the
1 3 following:
1 4 " . "Next-of-kin" means the surviving spouse and
1 5 heirs at law of the deceased."
1 6 #2. By striking page 1, line 34, through page 2,
1 7 line 13, and inserting the following:
1 8 "b. Following a period of at least sixty days
1 9 after the mailing of the notice to the director, the
1 10 seller shall disburse any remaining funds from the
1 11 burial trust fund as follows:
1 12 (1) If within the sixty-day period the seller
1 13 receives a claim from the personal representative of
1 14 the deceased, any remaining funds shall be disbursed
1 15 to the personal representative, notwithstanding any
1 16 claim by the director.
1 17 (2) If within the sixty-day period the seller has
1 18 not received a claim from the personal representative
1 19 of the deceased but receives a claim from the
1 20 director, the seller shall disburse the remaining
1 21 funds up to the amount of the claim to the director.
1 22 (3) Any remaining funds not disposed of pursuant
1 23 to subparagraphs (1) and (2) shall be disbursed to any
1 24 person who is identified as the next-of-kin of the
1 25 deceased in an affidavit submitted in accordance with
1 26 subsection 6."
