  1  1    Amend Senate File 413 as follows:
  1  2    #1.  Page 7, by inserting after line 30 the
  1  3 following:
  1  4    "Sec.    .  Section 455G.9, subsection 4, paragraph
  1  5 a, Code 1995, is amended to read as follows:
  1  6    a.  An owner or operator who reports a release to
  1  7 the department of natural resources after May 5, 1989,
  1  8 and on or before October 26, 1990, shall be required
  1  9 to pay the following copayment amounts:
  1 10    (1)  If the owner or operator has a net worth of
  1 11 one hundred thousand dollars or less, the owner or
  1 12 operator shall pay no more than eighteen percent of
  1 13 the total costs of corrective action for that release.
  1 14 For purposes of this subparagraph, "net worth" means
  1 15 the fair market value of the site, which shall include
  1 16 an adjustment for anticipated benefits under this
  1 17 section.
  1 18    (1) (2)  If a site's total anticipated expenses are
  1 19 not reserved for more than, or actual expenses do not
  1 20 exceed, eighty thousand dollars, the owner or operator
  1 21 shall pay the greater of five thousand dollars or
  1 22 eighteen percent of the total costs of corrective
  1 23 action for that release.
  1 24    (2) (3)  If a site's total anticipated expenses are
  1 25 reserved for more than, or actual expenses exceed,
  1 26 eighty thousand dollars, the owner or operator shall
  1 27 pay the amount as designated in subparagraph (1) (2)
  1 28 plus thirty-five percent of the total costs of the
  1 29 corrective action for that release which exceed eighty
  1 30 thousand dollars."
