PAG LIN 1 1 Amend the Senate amendment, H-3928, to House File 1 2 471, as amended, passed, and reprinted by the House, 1 3 as follows: 1 4 #1. Page 1, line 12, by striking the words "in the 1 5 possession or" and inserting the following: "using or 1 6 in". 1 7 #2. Page 1, line 24, by striking the words "term 1 8 less than" and inserting the following: "mandatory 1 9 minimum term which is less than the mandatory minimum 1 10 term which is". 1 11 #3. Page 2, by inserting after line 23, the 1 12 following: 1 13 " . A representative from a county board of 1 14 supervisors." 1 15 #4. Page 2, line 35, by striking the word 1 16 "rehabilitation" and inserting the following: 1 17 "rehabilitation,". 1 18 #5. Page 2, line 38, by inserting after the word 1 19 "process." the following: "In conducting the study, 1 20 the department shall also consult with faculty members 1 21 with expertise in risk assessment who are from Iowa 1 22 institutions of higher education which offer degree 1 23 programs in criminology." 1 24 #6. Page 2, by inserting after line 40, the 1 25 following: 1 26 "Sec. . SPLIT-SENTENCING PILOT PROJECT. 1 27 1. The general assembly finds that the 1 28 implementation of a split-sentencing pilot project 1 29 within this state could serve as a test for a fair and 1 30 flexible method of dispensing criminal justice which 1 31 provides for an incremental approach to the imposition 1 32 of aggravated misdemeanor and felony criminal 1 33 sentences and may help to reduce the current prison 1 34 overcrowding problems while protecting the public 1 35 safety. A split-sentencing pilot project is therefore 1 36 established in a judicial district to be determined by 1 37 the supreme court. The judicial district shall be 1 38 selected based on the availability of jail space 1 39 within the judicial district, and whether the judicial 1 40 district in consultation with the county board or 1 41 boards of supervisors and the sheriff or sheriffs 1 42 desires to participate in the project. 1 43 Notwithstanding any other contrary provision of law, 1 44 subsection 2 of this section shall apply within and 1 45 only within the judicial district which is selected to 1 46 participate in this pilot project from the date of the 1 47 enactment of this Act through June 30, 1996. 1 48 2. By record entry at the time of or after 1 49 sentencing for an aggravated misdemeanor or a felony, 1 50 other than a class "A" felony, the court may sentence 2 1 the defendant to serve up to ninety days of the 2 2 sentence in the county jail and suspend the balance of 2 3 the term imposed. If the person is ordered to serve 2 4 up to ninety days in jail, the costs of the person's 2 5 confinement shall be paid by the state at the rate 2 6 negotiated by the department of corrections with the 2 7 judicial district under section 904.908. Payment 2 8 shall be made by the department of revenue and finance 2 9 upon submission of a voucher executed by the sheriff. 2 10 Persons serving time in a county jail under this 2 11 subsection shall be committed to the custody of the 2 12 director of the department of corrections and the 2 13 department shall be responsible for all prisoner 2 14 medical costs."" 2 15 #7.
