Section 562A.5, Code 1995, is amended 1 6 by adding the following new subsection: 1 7 NEW SUBSECTION. 8. Occupancy in housing owned by 1 8 a nonprofit organization whose purpose is to provide 1 9 transitional housing for persons released from drug or 1 10 alcohol treatment facilities and in housing for 1 11 homeless persons. 1 12 Sec. . Section 562A.6, Code 1995, is amended by 1 13 adding the following new subsection: 1 14 NEW SUBSECTION. 15. "Transitional housing" means 1 15 temporary or nonpermanent housing. 1 16 Sec. . Section 562A.21, subsection 1, 1 17 unnumbered paragraph 1, Code 1995, is amended to read 1 18 as follows: 1 19 Except as provided in this chapter, if there is a 1 20 material noncompliance by the landlord with the rental 1 21 agreement or a noncompliance with section 562A.15 1 22 materially affecting health and safety, the tenant may 1 23 elect to commence an action under this section and 1 24 shall deliver a written notice to the landlord 1 25 specifying the acts and omissions constituting the 1 26 breach and that the rental agreement will terminate 1 27 upon a date not less thanthirtyseven days after 1 28 receipt of the notice if the breach is not remedied in 1 29fourteenseven days, and the rental agreement shall 1 30 terminate and the tenant shall surrender as provided 1 31 in the notice subject to the following: 1 32 Sec. . Section 562A.21, subsection 1, paragraph 1 33 b, Code 1995, is amended to read as follows: 1 34 b. If substantially the same act or omission which 1 35 constituted a prior noncompliance of which notice was 1 36 given recurs within six months, the tenant may 1 37 terminate the rental agreement upon at leastfourteen1 38 seven days' written notice specifying the breach and 1 39 the date of termination of the rental agreement unless 1 40 the landlord has exercised due diligence and effort to 1 41 remedy the breach which gave rise to the 1 42 noncompliance." 1 43 #2.
