  1  1    Amend Senate File 481 as follows:
  1  2    #1.  Page 14, by inserting after line 5 the
  1  3 following:
  1  4    "Sec.    .  NEW SECTION.  321.179  COUNTY
  1  5 TREASURERS &endash; ISSUANCE OF MOTOR VEHICLE LICENSES.
  1  6    Notwithstanding the provisions of this chapter or
  1  7 chapter 321L which grant sole authority to the
  1  8 department for the issuance of motor vehicle licenses,
  1  9 nonoperator's identification cards, and handicapped
  1 10 identification devices, the counties of Adams, Cass,
  1 11 Fremont, Mills, Montgomery, and Page shall be
  1 12 authorized to issue motor vehicle licenses on a
  1 13 permanent basis.  The department shall certify the
  1 14 county treasurers in the permanent counties to issue
  1 15 commercial driver's licenses provided that all of the
  1 16 following occur:
  1 17    1.  The driving skills test is the same as that
  1 18 which would otherwise be administered by the state.
  1 19    2.  The county examiner contractually agrees to
  1 20 comply with the requirements of 49 C.F.R. } 383.75,
  1 21 adopted as of a specific date by rule by the
  1 22 department."
  1 23    3.  The department provides supervision over the
  1 24 issuance of commercial driver's licenses."
  1 25    #2.  Page 14, by inserting after line 32 the
  1 26 following:
  1 27    "Sec.    .  ISSUANCE OF MOTOR VEHICLE LICENSES BY
  1 28 COUNTY TREASURERS &endash; PILOT PROJECT EXPANSION.
  1 29    1.  Twelve counties in addition to those counties
  1 30 referenced in section 321.179, as created in this Act,
  1 31 shall be included in the motor vehicle license
  1 32 issuance pilot project originally established pursuant
  1 33 to 1993 Iowa Acts, chapter 169, section 14.  The
  1 34 department shall select the twelve new counties from a
  1 35 pool of counties which have requested to participate
  1 36 in the pilot project.  The county treasurers' offices
  1 37 in the designated counties shall issue motor vehicle
  1 38 licenses, including commercial driver's licenses,
  1 39 nonoperator's identification cards, and handicapped
  1 40 identification devices.
  1 41    2.  The state department of transportation shall
  1 42 work in conjunction with the county treasurer in each
  1 43 designated county and with a representative of the
  1 44 Iowa state county treasurers association to facilitate
  1 45 and implement the transfer of licensing duties and
  1 46 responsibilities to the designated counties in
  1 47 accordance with all of the following:
  1 48    a.  The department shall retain all administrative
  1 49 authority over licensing functions which shall include
  1 50 supervision over issuance of commercial driver's
  2  1 licenses and administrative procedures relating to
  2  2 cancellation, revocation, or suspension of licenses,
  2  3 administrative hearings and appeals, and training.
  2  4    b.  The department shall provide the county
  2  5 treasurer's office in each of the counties with all of
  2  6 the supplies, materials, and equipment necessary to
  2  7 carry out the provisions of this subsection.
  2  8    c.  If it is necessary for a county treasurer to
  2  9 hire additional employees first priority in hiring
  2 10 shall be given to current employees of the department
  2 11 who become unemployed due to the changes necessitated
  2 12 by this section.
  2 13    d.  The county treasurers in the designated
  2 14 counties shall be required to offer hours and days of
  2 15 service to the public equal to or greater than the
  2 16 hours and days of service provided by the state
  2 17 department of transportation in the designated county
  2 18 immediately prior to the start of the county's
  2 19 provision of the service.
  2 20    e.  The department shall certify the county
  2 21 treasurers in each designated county to issue
  2 22 commercial driver's licenses provided that all of the
  2 23 following occur:
  2 24    (1)  The driving skills test is the same as that
  2 25 which would otherwise be administered by the state.
  2 26    (2)  The county examiner contractually agrees to
  2 27 comply with the requirements of 49 C.F.R. } 383.75,
  2 28 adopted as of a specific date by rule by the
  2 29 department.
  2 30    (3)  The department provides supervision over
  2 31 issuance of commercial driver's licenses.
  2 32    Sec.    .  The state department of transportation
  2 33 shall provide moneys to the eighteen counties
  2 34 designated as either permanent or pilot project
  2 35 counties in this Act for the costs of implementing and
  2 36 complying with the provisions of this Act.  The moneys
  2 37 shall be allocated from road use tax fund moneys
  2 38 appropriated to the motor vehicle division of the
  2 39 state department of transportation."
