  1  1    Amend House File 247, as amended, passed, and
  1  2 reprinted by the House, as follows:
  1  3    #1.  Page 1, by inserting before line 1 the
  1  4 following:
  1  5    "Sec.    .  Section 87.4, Code 1995, is amended by
  1  6 adding the following new unnumbered paragraph:
  1  7    NEW UNNUMBERED PARAGRAPH.  The workers'
  1  8 compensation premium written on a municipality which
  1  9 is a member of an insurance pool which provides
  1 10 workers' compensation insurance coverage to a
  1 11 statewide group of municipalities, as defined in
  1 12 section 670.1, shall not be considered in the
  1 13 determination of any assessments levied pursuant to an
  1 14 agreement established under section 515A.15."
  1 15    #2.  Page 8, by striking lines 6 through 18 and
  1 16 inserting the following:
  1 17    "Sec.    .  Section 515A.15, Code 1995, is amended
  1 18 to read as follows:
  1 19    515A.15  ASSIGNED RISKS.
  1 20    Agreements may shall be made among insurers with
  1 21 respect to the equitable apportionment among them of
  1 22 insurance which may be afforded applicants who are in
  1 23 good faith entitled to but who are unable to procure
  1 24 such insurance through ordinary methods and such
  1 25 insurers may agree among themselves on the use of
  1 26 reasonable rate modifications for such insurance, such
  1 27 the agreements and rate modifications to be subject to
  1 28 the approval of the commissioner.
  1 29    For purposes of this section, "insurer" includes,
  1 30 in addition to insurers defined pursuant to section
  1 31 515A.2, a self-insurance association formed pursuant
  1 32 to section 87.4 except for an association comprised of
  1 33 cities or counties, or both, or an association
  1 34 comprised of community colleges as defined in section
  1 35 260C.2, which have entered into an agreement pursuant
  1 36 to chapter 28E for the purpose of establishing a self-
  1 37 insured program for the payment of workers'
  1 38 compensation benefits."
  1 39    #3.  By renumbering as necessary.
