PAG LIN 1 1 Amend House File 334, as amended, passed, and 1 2 reprinted by the House, as follows: 1 3 #1. Page 1, by inserting before line 1 the 1 4 following: 1 5 "Section 1. INTERIM POVERTY STUDY. The 1 6 legislative council is requested to authorize an 1 7 interim study to assess the impact of poverty on 1 8 decisionmaking, teaching, learning systems, and on the 1 9 students in Iowa's K-12 public schools, utilizing the 1 10 primary and secondary risk factors specified in 281 1 11 IAC 65(4-5) for identifying the at-risk population of 1 12 a school district or building. The study shall be 1 13 conducted under the leadership of the chairpersons and 1 14 the ranking members of the standing education 1 15 committees of the senate and house of representatives, 1 16 in collaboration with, and with the assistance and 1 17 support of, the department of education, the 1 18 department of human services, the department of 1 19 economic development, and other public and nonpublic 1 20 institutions and agencies deemed appropriate by the 1 21 council. The council is further requested to provide 1 22 funds sufficient for administrative needs and to 1 23 contract for research and support staffing. The study 1 24 committee shall define the conditions of poverty, 1 25 estimate the number of dropouts and the number of 1 26 families and children living in poverty, identify the 1 27 local, state and federal subsidies provided for 1 28 students and their families living in poverty, compare 1 29 the conditions in Iowa with the conditions in other 1 30 states in the midwest relating to poverty and the 1 31 states' responses to the conditions, and establish an 1 32 ongoing procedure to track the impact of poverty on 1 33 education, health conditions, and the job market. The 1 34 study committee shall submit its findings and 1 35 recommendations to the general assembly by January 15, 1 36 1996. 1 37 Sec. 2. NEW SECTION. 257.50 TRANSPORTATION 1 38 ASSISTANCE AID TO DISTRICTS. 1 39 1. The department shall pay transportation 1 40 assistance aid to a school district from funds as 1 41 provided in this section to school districts whose 1 42 average transportation costs per pupil exceed the 1 43 state average transportation costs per pupil 1 44 determined under subsection 2 by one hundred percent. 1 45 2. A district's average transportation costs per 1 46 pupil shall be determined by dividing the district's 1 47 actual cost for all children transported in all school 1 48 buses for a school year pursuant to section 285.1, 1 49 subsection 12, less the amount received for 1 50 transporting nonpublic school pupils under section 2 1 285.1, by the district's actual enrollment for the 2 2 school year, less the shared-time enrollment for the 2 3 school year, as defined in section 257.6. The state 2 4 average transportation costs per pupil shall be 2 5 determined by dividing the total actual costs for all 2 6 children transported in all districts for a school 2 7 year, by the total of all districts' actual 2 8 enrollments for the school year. 2 9 3. To be eligible for transportation assistance 2 10 aid, a school district shall annually certify its 2 11 actual cost for all children transported in all school 2 12 buses not later than July 31 after each school year on 2 13 forms prescribed by the department of education. 2 14 4. If a school district's average transportation 2 15 costs per pupil exceed the state average 2 16 transportation costs per pupil by one hundred percent, 2 17 the department of education shall pay transportation 2 18 assistance aid equal to the amount of the difference 2 19 multiplied by the district's actual enrollment for the 2 20 school year less the shared-time enrollment for the 2 21 school year as defined in section 257.6. 2 22 5. There is appropriated from the general fund of 2 23 the state to the department of education, for each 2 24 fiscal year, an amount necessary to pay transportation 2 25 assistance aid pursuant to this section. 2 26 Transportation assistance aid is miscellaneous income 2 27 for purposes of chapter 257. 2 28 6. If the general assembly creates an Iowa 2 29 education transportation enhancement fund in the 2 30 office of the treasurer of state, the department shall 2 31 pay transportation assistance aid to a school district 2 32 that meets the requirements of this section from 2 33 moneys credited to the Iowa education transportation 2 34 enhancement fund. If moneys in the fund are 2 35 insufficient for purposes of this subsection, there is 2 36 appropriated from the general fund of the state to the 2 37 department of education, for each fiscal year, an 2 38 amount sufficient to pay the remaining transportation 2 39 assistance aid necessary under this section. 2 40 Transportation assistance aid is miscellaneous income 2 41 for purposes of chapter 257." 2 42 #2. Page 2, by inserting after line 28 the 2 43 following: 2 44 "Sec. . Section 285.3, Code 1995, is amended by 2 45 striking the section and inserting in lieu thereof the 2 46 following: 2 47 285.3 PARENTAL REIMBURSEMENT FOR NONPUBLIC SCHOOL 2 48 STUDENT TRANSPORTATION. 2 49 1. A parent or legal guardian of a nonpublic 2 50 school student, who furnishes transportation to the 3 1 student pursuant to section 285.1, shall notify the 3 2 resident public school district that the child is 3 3 enrolled and attending an accredited nonpublic school. 3 4 In addition, the parent or legal guardian shall 3 5 provide the name, age, and grade level of the student, 3 6 and the name of the accredited nonpublic school and 3 7 its location. The resident district shall submit 3 8 claims on behalf of a parent or legal guardian of a 3 9 nonpublic school student by February 1 and July 15 of 3 10 each school year unless the parent or legal guardian 3 11 fails to notify the district pursuant to this 3 12 subsection. 3 13 2. A parent or legal guardian of a nonpublic 3 14 school student who furnishes transportation for the 3 15 child pursuant to section 285.1 is entitled to 3 16 reimbursement equal to an amount calculated under the 3 17 provisions of section 285.1, subsection 3. In 3 18 addition, nonpublic school parents or legal guardians 3 19 who transport one or more family members more than 3 20 four miles to their accredited nonpublic schools of 3 21 attendance shall be entitled to one supplemental 3 22 mileage payment per family, per claim period, equal to 3 23 fifteen percent of the parental reimbursement amount, 3 24 rounded to the nearest whole dollar, when calculated 3 25 under the provisions of section 285.1, subsection 3." 3 26 Sec. . Section 257.50, subsection 5, as enacted 3 27 by this Act, is amended by striking the subsection 3 28 effective January 1, 1997. 3 29 Sec. . Section 257.50, subsection 6, as enacted 3 30 by this Act, takes effect January 1, 1997". 3 31 #3.
