  1  1    Amend Senate File 179 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 24.6, Code 1995, is amended to
  1  5 read as follows:
  1  6    24.6  EMERGENCY FUND &endash; LEVY.
  1  7    A municipality may include in the estimate
  1  8 required, an estimate for an emergency fund.  A
  1  9 municipality may assess and levy a tax for the
  1 10 emergency fund at a rate not to exceed twenty-seven
  1 11 cents per thousand dollars of assessed value of
  1 12 taxable property of the municipality, provided that an
  1 13 emergency tax levy shall not be made until the
  1 14 municipality has first petitioned the state board and
  1 15 received its approval.  Transfers of moneys may be
  1 16 made from the emergency fund to any other fund of the
  1 17 municipality for the purpose of meeting deficiencies
  1 18 in a fund arising from any cause, provided that a
  1 19 transfer shall not be made except upon the written
  1 20 approval of the state board, and then only when that
  1 21 approval is requested by a two-thirds vote of the
  1 22 governing body of the municipality.  However, a county
  1 23 hospital located in a county having a population of
  1 24 two hundred twenty-five thousand or over shall not
  1 25 levy a tax under this section."
  1 26    #2.  Title page, line 1, by striking the word
  1 27 "increasing" and inserting the following:  "relating
  1 28 to".
  1 29    #3.  By renumbering as necessary.
