PAG LIN 1 1 Amend Senate File 120 as follows: 1 2 #1. Page 1, by inserting before line 1 the 1 3 following: 1 4 "Section 1. NEW SECTION. 904.516 ACADEMIC 1 5 ACHIEVEMENT OF INMATES &endash; LITERACY AND HIGH SCHOOL 1 6 EQUIVALENCY PROGRAMS. 1 7 1. Effective July 1, 1997, a person who is 1 8 committed to the custody of the director of the 1 9 department of corrections may be evaluated for 1 10 purposes of determining the level of achievement in 1 11 the basic skills of arithmetic, the communicative arts 1 12 of reading, writing, grammar, and spelling, social 1 13 studies, and the sciences. 1 14 2. Persons who demonstrate functional literacy 1 15 competence below the sixth grade level may be required 1 16 to participate in literacy programs established by the 1 17 department. Participation shall be voluntary, but 1 18 shall be reflected as part of the person's record at 1 19 the institution. Persons who are required to 1 20 participate in literacy programs and who refuse to 1 21 participate shall be subject to the following 1 22 penalties: 1 23 a. Eligibility only for a minimum allowance. 1 24 b. Placement on idle status. 1 25 c. Ineligibility for work bonuses. 1 26 d. Ineligibility for minimum out or minimum live 1 27 out status. 1 28 e. Ineligibility for other privileges as 1 29 determined by the department. 1 30 3. Persons who have not completed the requirements 1 31 for high school or a high school equivalency diploma 1 32 may be required to complete the requirements for and 1 33 to obtain a high school equivalency diploma under 1 34 chapter 259A. 1 35 4. The department, in cooperation with the board 1 36 of parole, shall adopt rules which establish a 1 37 procedure for evaluation of inmates to determine basic 1 38 skills achievement, and criteria for placement of 1 39 inmates in educational programs. Rules adopted may 1 40 include, but shall not be limited to, the 1 41 establishment of standards for the development of 1 42 appropriate programming, imposition of any applicable 1 43 penalties, and for waiver of any educational 1 44 requirements." 1 45 #2. Page 1, line 3, by striking the word "shall" 1 46 and inserting the following: "may, effective July 1, 1 47 1997". 1 48 #3. Page 1, line 5, by inserting after the word 1 49 "capable" the following: "to demonstrate functional 1 50 literacy competence at or above the sixth grade level 2 1 or". 2 2 #4. Page 1, by inserting after line 8 the 2 3 following: 2 4 "Sec. . PROGRESS REPORTS &endash; BUDGET REQUEST. 2 5 The department of corrections shall submit, as part of 2 6 the department's budget request to the governor, plans 2 7 for the implementation of this Act by July 1, 1997. 2 8 The department shall also submit a report, in January 2 9 of 1996, to the general assembly which outlines the 2 10 progress made towards implementation of this Act." 2 11 #5. Title page, line 1, by inserting after the 2 12 word "inmates" the following: "demonstrate functional 2 13 literacy competence at or above the sixth grade level 2 14 or". 2 15 #6. Title page, line 2, by striking the word 2 16 "prior" and inserting the following: ", conditioning 2 17 receipt of certain privileges on participation in 2 18 education programs, and permitting the use of 2 19 educational competence as a precondition". 2 20 #7.
