  1  1    Amend Senate Resolution 5 as follows:
  1  2    #1.  Page 10, by striking lines 13 through 19 and
  1  3 inserting the following:
  1  4    "(4)  Cause the complaint to be scheduled for a
  1  5 public hearing upon receipt of the report of the
  1  6 independent special counsel, or
  1  7    (5)  Dismiss the complaint upon receipt of a report
  1  8 by independent special counsel that insufficient
  1  9 evidence exists to support a finding of probable
  1 10 cause.
  1 11    g.  Public hearing.  If independent special counsel
  1 12 is appointed, upon receipt of the report of
  1 13 independent special counsel's findings, the committee
  1 14 shall schedule a public meeting to review the report
  1 15 and shall either:
  1 16    (1)  Cause the complaint to be scheduled for a
  1 17 public hearing.
  1 18    (2)  Dismiss the complaint based upon a
  1 19 determination by independent special counsel and the
  1 20 committee that insufficient evidence exists to support
  1 21 a finding of probable cause."
  1 22    #2.  Page 12, line 6, by striking the words
  1 23 "appointed by the committee" and inserting the
  1 24 following:  "appointed by the committee".
  1 25    #3.  Page 13, line 9, by inserting after the word
  1 26 "assembly." the following:  "However, the report may
  1 27 be submitted to and considered during any special
  1 28 session which may take place after the second regular
  1 29 session of a general assembly has adjourned sine die,
  1 30 but before the convening of the next general
  1 31 assembly."
