  1  1    Amend Senate File 13 as follows:
  1  2    #1.  By striking everything after the enacting
  1  3 clause and inserting the following:
  1  4    "Section 1.  NEW SECTION.  146A.1  NOTIFICATION OF
  1  5 PARENT BY MINOR CONTEMPLATING AN ABORTION &endash;
  1  6 REQUIREMENTS &endash; EXCEPTIONS.
  1  7    1.  A minor seeking or contemplating seeking an
  1  8 abortion shall notify a parent of the minor of the
  1  9 minor's intention and shall seek counseling from the
  1 10 parent.
  1 11    2.  Notwithstanding subsection 1, if a minor is
  1 12 unable to comply with the notification requirement
  1 13 pursuant to subsection 1, because notification is not
  1 14 in the best interest of the minor due to, but not
  1 15 limited to, rape, incest, or the dysfunctional nature
  1 16 of the minor's family, the minor may comply with the
  1 17 requirement of subsection 1, by receiving counseling
  1 18 from any of the following individuals, none of whom is
  1 19 associated with an abortion provider, regarding the
  1 20 alternatives available to the minor for managing the
  1 21 pregnancy and verifying the receipt of counseling as
  1 22 required in subsection 3:
  1 23    a.  A grandparent of the minor.
  1 24    b.  A physician licensed to practice medicine or
  1 25 surgery pursuant to chapter 148, osteopathy pursuant
  1 26 to chapter 150, or osteopathic medicine and surgery
  1 27 pursuant to chapter 150A.
  1 28    c.  A psychologist licensed pursuant to chapter
  1 29 154B.
  1 30    d.  A psychiatrist licensed pursuant to chapter
  1 31 148.
  1 32    e.  A social worker licensed pursuant to chapter
  1 33 154C.
  1 34    f.  A marital and family therapist licensed
  1 35 pursuant to chapter 154D.
  1 36    g.  A person who practices as a registered nurse or
  1 37 as a licensed practical nurse pursuant to chapter 152.
  1 38    h.  A physician assistant licensed pursuant to
  1 39 chapter 148C.
  1 40    i.  A licensed advanced registered nurse
  1 41 practitioner certified as a nurse-midwife.
  1 42    j.  A person ordained or designated as a leader of
  1 43 a religious faith.
  1 44    3.  If a minor seeks to arrange an abortion, a
  1 45 person performing the abortion shall not perform the
  1 46 abortion unless the minor provides one of the
  1 47 following forms of verification of compliance with
  1 48 subsection 1 or 2:
  1 49    a.  If the minor complies with subsection 1,
  1 50 verification may be provided by either of the
  2  1 following means:
  2  2    (1)  A parent accompanies the minor during the
  2  3 performance of the abortion.
  2  4    (2)  A parent signs and dates a letter indicating
  2  5 the parent's notification of the abortion.
  2  6    b.  If the minor complies with subsection 2, the
  2  7 minor shall provide a form signed and dated by the
  2  8 individual providing counseling, verifying receipt of
  2  9 counseling by the minor.
  2 10    4.  A minor is not required to comply with
  2 11 subsection 1 or 2 if the minor's attending physician
  2 12 certifies that a medical emergency exists.  If
  2 13 noncompliance with either subsection is by reason of a
  2 14 medical emergency, the attending physician shall
  2 15 certify, in writing, in the minor's medical record,
  2 16 the basis for the medical judgment that a medical
  2 17 emergency existed.
  2 18    5.  For the purposes of this section:
  2 19    a.  "Abortion" means an abortion as defined in
  2 20 section 146.1.
  2 21    b.  "Medical emergency" means a condition that,
  2 22 based on a physician's good faith clinical judgment,
  2 23 so complicates the medical condition of the minor as
  2 24 to necessitate the immediate abortion of the minor's
  2 25 pregnancy to avert the minor's death, or for which a
  2 26 delay will create serious risk of substantial and
  2 27 irreversible impairment of a major bodily function.
  2 28    c.  "Minor" means minor as defined in section
  2 29 599.1.
  2 30    d.  "Parent" means one parent of the minor or the
  2 31 minor's guardian or custodian.
  2 32    6.  A person who uses reasonable diligence in
  2 33 providing counseling under subsection 2 and in
  2 34 complying with the requirements of this section, is
  2 35 immune from any liability, civil or criminal, which
  2 36 might arise under this section."
  2 37    #2.  Title page, by striking lines 1 through 3 and
  2 38 inserting the following:  "An Act relating to the
  2 39 notification of a parent by a minor contemplating an
  2 40 abortion and providing alternatives."
