PAG LIN 1 1 COLLEGE STUDENT AID COMMISSION 1 2 Section 1. There is appropriated from the general fund of 1 3 the state to the college student aid commission for the fiscal 1 4 year beginning July 1, 1996, and ending June 30, 1997, the 1 5 following amounts, or so much thereof as may be necessary, to 1 6 be used for the purposes designated: 1 7 1. GENERAL ADMINISTRATION 1 8 For salaries, support, maintenance, miscellaneous purposes, 1 9 and for not more than the following full-time equivalent 1 10 positions: 1 11 .................................................. $ 317,797 1 12 ............................................... FTEs 7.05 1 13 The college student aid commission shall conduct a study of 1 14 the changes in the grants awarded that are based on parental 1 15 income and assets under the Iowa tuition grant program. The 1 16 commission shall submit a report of its findings and 1 17 recommendations to the general assembly by January 1, 1997. 1 18 2. UNIVERSITY OF OSTEOPATHIC MEDICINE AND HEALTH SCIENCES 1 19 a. For forgivable loans to Iowa students attending the 1 20 university of osteopathic medicine and health sciences, under 1 21 the forgivable loan program pursuant to section 261.19A: 1 22 .................................................. $ 379,260 1 23 b. For the university of osteopathic medicine and health 1 24 sciences for an initiative in primary health care to direct 1 25 primary care physicians to shortage areas in the state: 1 26 .................................................. $ 345,000 1 27 The moneys appropriated in this lettered paragraph shall be 1 28 used as follows: 1 29 (1) To reduce student loan debt for primary care 1 30 physicians in an amount not to exceed $30,000 per student for 1 31 a four-year period of medical service in medically under- 1 32 served areas of the state. 1 33 (2) For tuition scholarships for students attending the 1 34 university of osteopathic medicine and health sciences who 1 35 agree to practice primary care medicine in medically under- 2 1 served areas of the state. The student shall practice in the 2 2 state two years for every year of tuition. A person receiving 2 3 funds under this subparagraph shall not be eligible for funds 2 4 under subparagraph (1). 2 5 (3) For general administration costs of the university for 2 6 the primary care initiative, the university shall expend an 2 7 amount not to exceed $50,000. 2 8 Within one month of the end of a fiscal quarter, the 2 9 university of osteopathic medicine and health sciences shall 2 10 submit a report to the legislative fiscal bureau concerning 2 11 the expenditure of funds used pursuant to subparagraphs (1), 2 12 (2), and (3) of this lettered paragraph. The university shall 2 13 also submit the annual audit of the university to the 2 14 legislative fiscal bureau within six months following the year 2 15 being audited. 2 16 The college student aid commission shall not provide moneys 2 17 for subparagraphs (1) and (2) of this lettered paragraph until 2 18 the university has signed and submitted contracts for the use 2 19 of these moneys for reduction of student loan debt and tuition 2 20 scholarships. Funds for subparagraph (3) of this lettered 2 21 paragraph shall be provided quarterly to the university. 2 22 Notwithstanding section 8.33, the funds for this lettered 2 23 paragraph shall not revert to the general fund but be 2 24 available for expenditure the following fiscal year for 2 25 purposes of subparagraphs (1) and (2). 2 26 The college student aid commission, the university of 2 27 osteopathic medicine and health sciences, and the legislative 2 28 fiscal bureau shall cooperatively develop and propose uniform 2 29 time periods of medical practice in the state which shall be 2 30 served in return for an allocation of state funds for purposes 2 31 of the university of osteopathic medicine and health sciences. 2 32 Proposals developed may relate to allocations of funds within 2 33 a single appropriation concept and include contracting 2 34 provisions. Proposals shall be submitted in a report to the 2 35 general assembly by January 1, 1997. 3 1 3. FTEs 94.95 5 9 The department of education shall conduct a study of the 5 10 special education funding system with the following goals: 5 11 increasing the capacity of the whole school to meet the needs 5 12 of all children; increasing support available to "at-risk" 5 13 students; and ensuring predictable and equitable special 5 14 education funding at both the state and local levels. The 5 15 study shall include, but is not limited to, an examination of 5 16 the consequences of increasing the current special education 5 17 weights and the impact that will have on those districts whose 5 18 expenditures exceed the amount generated under the present 5 19 weighting plan and on those districts who are generating 5 20 sufficient funds; the issues and feasibility of alternative 5 21 special education funding systems based on school district 5 22 experiences with involvement from representatives of the 5 23 education community, including special education teachers, 5 24 administrators, and advocacy groups; and the possibility of 5 25 establishing a funding system to address students that are 5 26 "at-risk" but are not currently eligible for special education 5 27 services. The department shall submit its findings and 5 28 specific recommendations in a report to the general assembly 5 29 and the legislative fiscal bureau by January 1, 1997. 5 30 The department of education shall conduct a study of the 5 31 trends in the number of students requiring services to become 5 32 proficient in the English language and the current and 5 33 projected costs related to providing such services by local 5 34 school districts. The department shall report its findings 5 35 and specific recommendations regarding funding to the general 6 1 assembly and the legislative fiscal bureau by January 1, 1997. 6 2 Funds appropriated from the general fund of the state to 6 3 the department of education shall not be used for personnel 6 4 contracts until all vacant full-time equivalent positions 6 5 which are funded are filled. 6 6 The department of education shall provide an annual report 6 7 of funds expended and activities accomplished in the k-12 and 6 8 community college management information system to the 6 9 legislative fiscal bureau and the general assembly by January 6 10 1. 6 11 2. Notwithstanding the limitation on the use of 10 17 moneys in the interest for Iowa school fund in section 10 18 257B.1A, any unobligated or unencumbered moneys in the 10 19 interest for Iowa school fund on June 30, 1996, shall be 10 20 transferred to the department of education for the fiscal year 10 21 beginning July 1, 1996, and ending June 30, 1997, the 10 22 following amounts, or so much thereof as is necessary, to be 10 23 used for the purposes designated: 10 24 1. At least 50 percent of the funds 11 7 appropriated by the general assembly for the fiscal year 11 8 beginning July 1, 1996, and ending June 30, 1997, for purposes 11 9 of the local arts comprehensive educational strategies shall 11 10 be allocated to schools which are new participants in the 11 11 program. 11 12 If moneys in the interest for Iowa schools fund are 11 13 insufficient for purposes of the appropriation provided for 11 14 under this section, funds shall be allocated in the order of 11 15 the subsections, with the highest priority given to subsection 11 16 1. 11 17 Sec. 7. Notwithstanding section 8.33 and 1995 Iowa Acts, 11 18 chapter 218, section 1, subsection 17, funds appropriated and 11 19 allocated for advanced placement pursuant to 1995 Iowa Acts, 11 20 chapter 218, section 1, subsection 17, remaining unencumbered 11 21 and unobligated on June 30, 1996, shall not revert to the 11 22 general fund but shall be distributed by the department of 11 23 education for purposes of providing grants to support 11 24 qualifying teams for a worldwide academic competition. 11 25 STATE BOARD OF REGENTS 11 26 Sec. 8. There is appropriated from the general fund of the 11 27 state to the state board of regents for the fiscal year 11 28 beginning July 1, 1996, and ending June 30, 1997, the 11 29 following amounts, or so much thereof as may be necessary, to 11 30 be used for the purposes designated: 11 31 1. OFFICE OF STATE BOARD OF REGENTS 11 32 a. The state board of regents shall determine the board 11 33 office budget for each fiscal year. The board shall require 11 34 only the three institutions of higher education under the 11 35 control of the board to reimburse the board office expenses 12 1 based upon enrollment of the institutions. The board shall 12 2 maintain not more than 15.00 full-time equivalent positions 12 3 for the fiscal year beginning July 1, 1996, and ending June 12 4 30, 1997. The board shall prepare a quarterly report, 12 5 regarding the board office budget and the reimbursements 12 6 provided to the board by the institutions of higher learning 12 7 under the control of the board, which shall be submitted 12 8 quarterly to the general assembly and the legislative fiscal 12 9 bureau. 12 10 b. For allocation by the state board of regents to the 12 11 state university of Iowa, the Iowa state university of science 12 12 and technology, and the university of northern Iowa to 12 13 reimburse the institutions for deficiencies in their operating 12 14 funds resulting from the pledging of tuitions, student fees 12 15 and charges, and institutional income to finance the cost of 12 16 providing academic and administrative buildings and facilities 12 17 and utility services at the institutions: 12 18 .................................................. $ 27,106,881 12 19 The state board of regents, the department of management, 12 20 and the legislative fiscal bureau shall cooperate to determine 12 21 and agree upon, by November 15, 1996, the amount that needs to 12 22 be appropriated for tuition replacement for the fiscal year 12 23 beginning July 1, 1997. 12 24 c. The board shall review options regarding 13 4 relocation and submit recommendations to the legislative 13 5 fiscal bureau and the joint appropriations subcommittee on 13 6 education by January 1, 1997. 13 7 2. STATE UNIVERSITY OF IOWA 13 8 a. General university, including lakeside laboratory 13 9 For salaries, support, maintenance, equipment, 13 10 miscellaneous purposes, and for not more than the following 13 11 full-time equivalent positions: 13 12 .................................................. $202,267,198 13 13 ............................................... FTEs 5,701.67 13 30 Funds appropriated in this lettered paragraph shall not be 13 31 used to perform abortions except medically necessary 13 32 abortions, and shall not be used to operate the early 13 33 termination of pregnancy clinic except for the performance of 13 34 medically necessary abortions. For the purpose of this 13 35 lettered paragraph, an abortion is the purposeful interruption 14 1 of pregnancy with the intention other than to produce a live- 14 2 born infant or to remove a dead fetus, and a medically 14 3 necessary abortion is one performed under one of the following 14 4 conditions: 14 5 (1) The attending physician certifies that continuing the 14 6 pregnancy would endanger the life of the pregnant woman. 14 7 (2) The attending physician certifies that the fetus is 14 8 physically deformed, mentally deficient, or afflicted with a 14 9 congenital illness. 14 10 (3) The pregnancy is the result of a rape which is 14 11 reported within 45 days of the incident to a law enforcement 14 12 agency or public or private health agency which may include a 14 13 family physician. 14 14 (4) The pregnancy is the result of incest which is 14 15 reported within 150 days of the incident to a law enforcement 14 16 agency or public or private health agency which may include a 14 17 family physician. 14 18 (5) The abortion is a spontaneous abortion, commonly known 14 19 as a miscarriage, wherein not all of the products of 14 20 conception are expelled. 14 21 The total quota allocated to the counties for indigent 14 22 patients for the fiscal year beginning July 1, 1996, shall not 14 23 be lower than the total quota allocated to the counties for 14 24 the fiscal year commencing July 1, 1995. The total quota 14 25 shall be allocated among the counties on the basis of the 1990 14 26 census pursuant to section 255.16. 14 27 d. Psychiatric hospital 14 28 For salaries, support, maintenance, equipment, 14 29 miscellaneous purposes, for the care, treatment, and 14 30 maintenance of committed and voluntary public patients, and 14 31 for not more than the following full-time equivalent 14 32 positions: 14 33 .................................................. $ 7,225,868 14 34 ............................................... Reallocations of sums received under section 8, 19 16 subsections 2, 3, 4, 5, and 6, of this Act, including sums 19 17 received for salaries, shall be reported on a quarterly basis 19 18 to the co-chairpersons and ranking members of the legislative 19 19 fiscal committee and the joint appropriations subcommittee on 19 20 education. 19 21 Sec. 11. Notwithstanding section 8.33, funds appropriated 19 22 in 1995 Iowa Acts, chapter 218, section 6, subsection 1, 19 23 paragraph "b", remaining unencumbered or unobligated on June 19 24 30, 1996, shall not revert to the general fund of the state 19 25 but shall be available for expenditure for the purposes listed 19 26 in section 8, subsection 1, paragraph "b", of this Act during 19 27 the fiscal year beginning July 1, 1996, and ending June 30, 19 28 1997. 19 29 Sec. 12. Notwithstanding the provisions of 1996 Iowa Acts, 19 30 Senate File 2195, if enacted, the university of northern Iowa 19 31 shall utilize the funds it receives under 1996 Iowa Acts, 19 32 Senate File 2195, if enacted, for coordinating staff 19 33 development for educators using educational technology at 19 34 local school districts and for increasing temporary staff and 19 35 support at the university of northern Iowa for technology 20 1 needs. 20 2 Sec. 13. MEDICAL ASSISTANCE – SUPPLEMENTAL AMOUNTS. For 20 3 the fiscal year beginning July 1, 1996, and ending June 30, 20 4 1997, the department of human services shall continue the 20 5 supplemental disproportionate share and a supplemental 20 6 indirect medical education adjustment applicable to state- 20 7 owned acute care hospitals with more than 500 beds and shall 20 8 reimburse qualifying hospitals pursuant to that adjustment 20 9 with a supplemental amount for services provided medical 20 10 assistance recipients. The adjustment shall generate 20 11 supplemental payments intended to equal the state 20 12 appropriation made to a qualifying hospital for treatment of 20 13 indigent patients as provided in chapter 255. To the extent 20 14 of the supplemental payments, a qualifying hospital shall, 20 15 after receipt of the funds, transfer to the department of 20 16 human services an amount equal to the actual supplemental 20 17 payments that were made in that month. The aggregate amounts 20 18 for the fiscal year shall not exceed the state appropriation 20 19 made to the qualifying hospital for treatment of indigent 20 20 patients as provided in chapter 255. The department of human 20 21 services shall deposit the portion of these funds equal to the 20 22 state share in the department's medical assistance account and 20 23 the balance shall be credited to the general fund of the 20 24 state. To the extent that state funds appropriated to a 20 25 qualifying hospital for the treatment of indigent patients as 20 26 provided in chapter 255 have been transferred to the 20 27 department of human services as a result of these supplemental 20 28 payments made to the qualifying hospital, the department shall 20 29 not, directly or indirectly, recoup the supplemental payments 20 30 made to a qualifying hospital for any reason, unless an 20 31 equivalent amount of the funds transferred to the department 20 32 of human services by a qualifying hospital pursuant to this 20 33 provision is transferred to the qualifying hospital by the 20 34 department. 20 35 If the state supplemental amount allotted to the state of 21 1 Iowa for the federal fiscal year beginning October 1, 1996, 21 2 and ending September 30, 1997, pursuant to section 1923 (f)(3) 21 3 of the federal Social Security Act, as amended, or pursuant to 21 4 federal payments for indirect medical education is greater 21 5 than the amount necessary to fund the federal share of the 21 6 supplemental payments specified in the preceding paragraph, 21 7 the department of human services shall increase the 21 8 supplemental disproportionate share or supplemental indirect 21 9 medical education adjustment by the lesser of the amount 21 10 necessary to utilize fully the state supplemental amount or 21 11 the amount of state funds appropriated to the state university 21 12 of Iowa general education fund and allocated to the university 21 13 for the college of medicine. The state university of Iowa 21 14 shall transfer from the allocation for the college of medicine 21 15 to the department of human services, on a monthly basis, an 21 16 amount equal to the additional supplemental payments made 21 17 during the previous month pursuant to this paragraph. A 21 18 qualifying hospital receiving supplemental payments pursuant 21 19 to this paragraph that are greater than the state 21 20 appropriation made to the qualifying hospital for treatment of 21 21 indigent patients as provided in chapter 255 shall be 21 22 obligated as a condition of its participation in the medical 21 23 assistance program to transfer to the state university of Iowa 21 24 general education fund on a monthly basis an amount equal to 21 25 the funds transferred by the state university of Iowa to the 21 26 department of human services. To the extent that state funds 21 27 appropriated to the state university of Iowa and allocated to 21 28 the college of medicine have been transferred to the 21 29 department of human services as a result of these supplemental 21 30 payments made to the qualifying hospital, the department shall 21 31 not, directly or indirectly, recoup these supplemental 21 32 payments made to a qualifying hospital for any reason, unless 21 33 an equivalent amount of the funds transferred to the 21 34 department of human services by the state university of Iowa 21 35 pursuant to this paragraph is transferred to the qualifying 22 1 hospital by the department. 22 2 Continuation of the supplemental disproportionate share and 22 3 supplemental indirect medical education adjustment shall 22 4 preserve the funds available to the university hospital for 22 5 medical and surgical treatment of indigent patients as 22 6 provided in chapter 255 and to the state university of Iowa 22 7 for educational purposes at the same level as provided by the 22 8 state funds initially appropriated for that purpose. 22 9 The department of human services shall, in any compilation 22 10 of data or other report distributed to the public concerning 22 11 payments to providers under the medical assistance program, 22 12 set forth reimbursements to a qualifying hospital through the 22 13 supplemental disproportionate share and supplemental indirect 22 14 medical education adjustment as a separate item and shall not 22 15 include such payments in the amounts otherwise reported as the 22 16 reimbursement to a qualifying hospital for services to medical 22 17 assistance recipients. 22 18 For purposes of this section, "supplemental payment" means 22 19 a supplemental payment amount paid for medical assistance to a 22 20 hospital qualifying for that payment under this section. 22 21 Sec. 14. For the fiscal year beginning July 1, 1996, and 22 22 ending June 30, 1997, the state board of regents may use 22 23 notes, bonds, or other evidences of indebtedness issued under 22 24 section 262.48 to finance projects that will result in energy 22 25 cost savings in an amount that will cause the state board to 22 26 recover the cost of the projects within an average of six 22 27 years. 22 28 Sec. 15. Notwithstanding section 270.7, the department of 22 29 revenue and finance shall pay the state school for the deaf 22 30 and the Iowa braille and sight saving school the moneys 22 31 collected from the counties for expenses relating to 22 32 prescription drug costs for students attending the state 22 33 school for the deaf and the Iowa braille and sight saving 22 34 school. 22 35 Sec. 16. Section 11.6, subsection 1, paragraph a, 23 1 unnumbered paragraph 1, Code 1995, is amended to read as 23 2 follows: 23 3 The financial condition and transactions of all cities and 23 4 city offices, counties, county hospitals organized under 23 5 chapters 347 and 347A, memorial hospitals organized under 23 6 chapter 37, entities organized under chapter 28E having gross 23 7 receipts in excess of one hundred thousand dollars in a fiscal 23 8 year, merged areas, area education agencies, and all school 23 9 offices in school districts, shall be examined at least once 23 10 each year, except that cities having a population of seven 23 11 hundred or more but less than two thousand shall be examined 23 12 at least once every four years, and cities having a population 23 13 of less than seven hundred may be examined as otherwise 23 14 provided in this section. The examination shall cover the 23 15 fiscal year next preceding the year in which the audit is 23 16 conducted. The examination of school offices shall include an 23 17 audit of all school funds, the certified annual financial 23 18 report, and the certified enrollment as provided in section 23 19 257.6.Examinations of community colleges shall include an23 20audit of eligible and noneligible contact hours as defined in23 21section 260D.2. Eligible and noneligible contact hours and23 22any differencesDifferences in certified enrollment shall be 23 23 reported to the department of management. 23 24 Sec. 17. Section 256.7, subsection 17, Code 1995, is 23 25 amended to read as follows: 23 26 17. Receive andreviewapprove the budget and unified plan 23 27 of service submitted by the division of libraries and 23 28 information services. 23 29 Sec. 18. Section 256.52, subsections 3 and 5, Code 1995, 23 30 are amended by striking the subsections. 23 31 Sec. 19. NEW SECTION. 256.57 STATE LIBRARIAN. 23 32 1. The director of the department of education shall 23 33 appoint the state librarian who shall administer the division, 23 34 and serve at the pleasure of the director. 23 35 2. The state librarian shall do all of the following: 24 1 a. Direct and organize the activities of the division. 24 2 b. Submit a biennial report to the governor on the 24 3 activities and an evaluation of the division and its programs 24 4 and policies. 24 5 c. Control all property of the division. The state 24 6 librarian may dispose of, through sale, conveyance, or 24 7 exchange, any library materials that may be obsolete or worn 24 8 out or that may no longer be needed or appropriate to the 24 9 mission of the state library of Iowa. These materials may be 24 10 sold by the state library directly or the library may sell the 24 11 materials by consignment with an outside entity. A state 24 12 library fund is created in the state treasury. Proceeds from 24 13 the sale of the library materials shall be remitted to the 24 14 treasurer of state and credited to the state library fund and 24 15 shall be used for the purchase of books and other library 24 16 materials. Notwithstanding section 8.33, any balance in the 24 17 fund on June 30 of any fiscal year shall not revert to the 24 18 general fund of the state. 24 19 d. Appoint and approve the technical, professional, 24 20 excepting the medical librarian and the law librarian, 24 21 secretarial, and clerical staff necessary to accomplish the 24 22 purposes of the division subject to chapter 19A. 24 23 e. Perform other duties imposed by law. 24 24 Sec. 20. Section 257.31, subsection 16, Code 1995, is 24 25 amended to read as follows: 24 26 16. The committee shall perform the duties assigned to it 24 27 underchapter 260D and sectionsections 257.32 and 260C.18B. 24 28 Sec. 21. Section 257B.1A, subsections 2 and 3, Code 24 29 Supplement 1995, are amended to read as follows: 24 30 2. For a transfer of moneys from the interest for Iowa 24 31 schools fund to the first in the nation in education 24 32 foundation, prior to July 1, October 1, January 1, and March 1 24 33 of each year, the governing board of the first in the nation 24 34 in education foundation established in section 257A.2 shall 24 35 certify to the treasurer of state the cumulative total value 25 1 of cash contributions received under section 257A.7 for 25 2 deposit in the first in the nation in education fund and for 25 3 the use of the foundation.The cumulative total value of25 4contributions received includes the value of the amount25 5deposited in the national center endowment fund established in25 6section 263.8A in excess of eight hundred seventy-five25 7thousand dollars. The value of in-kind contributions shall be25 8based upon the fair market value of the contribution25 9determined for income tax purposes.25 10 The portion of the interest for Iowa schools fund that is 25 11 equal to the cumulative total value of cash contributions,25 12less the portion of the interest for Iowa schools fund25 13dedicated to the national center for gifted and talented25 14education,is dedicated to the first in the nation in 25 15 education foundation for that year. The interest earned on 25 16 this dedicated amount shall be transferred by the treasurer of 25 17 state to the credit of the first in the nation in education 25 18 foundation. 25 19 3. For a transfer of moneys from the interest for Iowa 25 20 schools fund to the national center endowment fund established 25 21 in section 263.8A, prior to July 1, October 1, January 1, and 25 22 March 1 of each year, the state university of Iowa shall 25 23 certify to the treasurer of state the cumulative total value 25 24 of cash contributions received and deposited in the national 25 25 center endowment fund. Within fifteen days following 25 26 certification by the state university of Iowa, the treasurer 25 27 of state shall transfer from the interest for Iowa schools 25 28 fund to the national center an amount equal to one-half the 25 29 cumulative total value of the cash contributions deposited in 25 30 the national center endowment fund, not to exceed eight 25 31 hundred seventy-five thousand dollars. 25 32 Sec. 22. Section 260C.2, Code 1995, is amended by adding 25 33 the following new subsections: 25 34 NEW SUBSECTION. 1A. "Contact hour" means fifty minutes of 25 35 contact between an instructor and students in a scheduled 26 1 course offering for which students are registered. 26 2 NEW SUBSECTION. 2A. "Instructional cost center" means one 26 3 of the following areas of course offerings of the community 26 4 colleges: 26 5 a. Arts and sciences cost center. 26 6 b. Vocational-technical preparatory cost center. 26 7 c. Vocational-technical supplementary cost center. 26 8 d. Adult basic education and high school completion cost 26 9 center. 26 10 e. Continuing and general education cost center. 26 11 Sec. 23. Section 260C.14, Code 1995, is amended by adding 26 12 the following new subsections: 26 13 NEW SUBSECTION. 21. Annually submit to the department of 26 14 education and the legislative fiscal bureau, by August 15, on 26 15 forms designed by the department of education in consultation 26 16 with the community colleges, the following information, which 26 17 shall include, but is not limited to, the following: 26 18 a. The number of full-time and part-time students enrolled 26 19 in each program offered by the community college, listed by 26 20 program. 26 21 b. The number of and any appropriate demographic 26 22 information, including salaries of full-time and part-time 26 23 staff, relating to the faculty, administration, and support 26 24 personnel employed at each community college. 26 25 c. The full-time equivalent total of persons employed as 26 26 identified in paragraph "b". 26 27 d. Tuition charges, fees, and other costs payable to the 26 28 community college by a student. 26 29 e. The types of degrees granted by the community college 26 30 and the number of students receiving degrees. 26 31 f. Revenues and expenditures from state financial aid, 26 32 federal funds, tax levies, projects authorized under chapters 26 33 260E and 260F, tuition, bonds, other local sources, foundation 26 34 sources, and donations and gifts that may be accepted by the 26 35 governing board of a community college. 27 1 g. An inventory of buildings and facilities owned and 27 2 leased by the community college, and any related operation and 27 3 maintenance costs. 27 4 h. Infrastructure plans, which shall include, but are not 27 5 limited to, the amounts expended in the current fiscal year on 27 6 renovation and construction, and any future plans and 27 7 projected costs for expansion. 27 8 The department of education may withhold from a community 27 9 college any state financial assistance appropriated to the 27 10 department for allocation to the community college if the 27 11 community college fails to substantially meet the requirements 27 12 of this subsection. 27 13 NEW SUBSECTION. 22. Provide, within a reasonable time, 27 14 information as requested by the departments of management and 27 15 education. 27 16 Sec. 24. Section 260C.18, subsection 4, Code 1995, is 27 17 amended to read as follows: 27 18 4. State aid and supplemental state aid to be paid in 27 19 accordance with the statutes which provide such aid. 27 20 Sec. 25. NEW SECTION. 260C.18A STATE AID. 27 21 For the fiscal year beginning July 1, 1996, and for each 27 22 succeeding fiscal year, moneys appropriated by the general 27 23 assembly from the general fund of the state to the department 27 24 of education for community college purposes for general state 27 25 financial aid, including general financial aid to merged areas 27 26 in lieu of personal property tax replacement payments under 27 27 section 427A.13, to merged areas as defined in section 260C.2, 27 28 for vocational education programs in accordance with chapters 27 29 258 and 260C, to purchase instructional equipment for 27 30 vocational and technical courses of instruction in community 27 31 colleges, and for salary increases, for a fiscal year, shall 27 32 be allocated to each community college by the state board in 27 33 the proportion that the allocation to that community college 27 34 in 1995 Iowa Acts, chapter 218, section 1, subsection 19, 27 35 bears to the total appropriation made in 1995 Iowa Acts, 28 1 chapter 218, section 1, subsection 19. 28 2 Sec. 26. NEW SECTION. 260C.18B COMMUNITY COLLEGE BUDGET 28 3 REVIEW. 28 4 1. A community college budget review procedure is 28 5 established for the school budget review committee created in 28 6 section 257.30. The school budget review committee, in 28 7 addition to its duties under chapter 257, shall meet and hold 28 8 hearings each year under this chapter to review unusual 28 9 circumstances of community colleges, either upon the 28 10 committee's motion or upon the request of a community college. 28 11 The committee may grant supplemental state aid to the 28 12 community college from funds appropriated to the department of 28 13 education for community college budget review purposes. 28 14 Unusual circumstances shall include but not be limited to 28 15 the following: 28 16 a. An unusual increase or decrease in enrollment or 28 17 contact hours. 28 18 b. Natural disasters. 28 19 c. Unusual staffing problems. 28 20 d. Unusual necessity for additional funds to permit 28 21 continuance of a course or program in an instructional cost 28 22 center which provides substantial benefit to students. 28 23 e. Unusual need for a new course or program in an 28 24 instructional cost center which will provide substantial 28 25 benefit to students, if the community college establishes the 28 26 need and the amount of necessary increased cost. 28 27 f. Unique problems of community colleges to include 28 28 vandalism, civil disobedience, and other costs incurred by 28 29 community colleges. 28 30 2. When the school budget review committee makes a 28 31 decision under subsection 1, it shall provide written notice 28 32 of its decision, including the amount of supplemental state 28 33 aid approved, to the board of directors of the community 28 34 college and to the department of education. 28 35 3. All decisions by the school budget review committee 29 1 under this chapter shall be made in accordance with reasonable 29 2 and uniform policies which shall be consistent with this 29 3 chapter. 29 4 4. Failure by a community college to provide information 29 5 or appear before the school budget review committee as 29 6 requested for the accomplishment of review or hearing 29 7 constitutes justification for the committee to instruct the 29 8 department of revenue and finance to withhold supplemental 29 9 state aid to that community college until the committee's 29 10 inquiries are satisfied completely. 29 11 Sec. 27. Section 260C.34, Code 1995, is amended to read as 29 12 follows: 29 13 260C.34 USES OF FUNDS. 29 14 Funds obtained pursuant to section 260C.17; section 29 15 260C.18, subsections 3, 4, and 5of section 260C.18;section29 16 and sections 260C.18A, 260C.18B, 260C.19;, andsection260C.22 29 17 shall not be used for the construction or maintenance of 29 18 athletic buildings or grounds but may be used for a project 29 19 under section 260C.56. 29 20 Sec. 28. Section 260C.39, unnumbered paragraph 5, Code 29 21 1995, is amended to read as follows: 29 22 The terms of employment of personnel, for the academic year 29 23 following the effective date of the agreement to combine the 29 24 merged areas shall not be affected by the combination of the 29 25 merged areas, except in accordance with the procedures under 29 26 sections 279.15 to 279.18 and section 279.24, to the extent 29 27 those procedures are applicable, or under the terms of the 29 28 base bargaining agreement. The authority and responsibility 29 29 to offer new contracts or to continue, modify, or terminate 29 30 existing contracts pursuant to any applicable procedures under 29 31 chapter 279, shall be transferred to the acting, and then to 29 32 the new, board of the combined merged area upon certification 29 33 of a favorable vote to each of the merged areas affected by 29 34 the agreement. The collective bargaining agreement of the 29 35 merged areawith the largest number of contact hours eligible30 1forreceiving the greatest amount of general state aid 30 2 pursuant to section 260C.18A,as defined under section 260D.2,30 3 shall serve as the base agreement for the combined merged area 30 4 and the employees of the merged areas which combined to form 30 5 the new combined merged area shall automatically be accreted 30 6 to the bargaining unit from that former merged area for 30 7 purposes of negotiating the contracts for the following years 30 8 without further action by the public employment relations 30 9 board. If only one collective bargaining agreement is in 30 10 effect among the merged areas which are combining under this 30 11 section, then that agreement shall serve as the base 30 12 agreement, and the employees of the merged areas which are 30 13 combining to form the new combined merged area shall 30 14 automatically be accreted to the bargaining unit of that 30 15 former merged area for purposes of negotiating the contracts 30 16 for the following years without further action by the public 30 17 employment relations board. The board of the combined merged 30 18 area, using the base agreement as its existing contract, shall 30 19 bargain with the combined employees of the merged areas that 30 20 have agreed to combine for the academic year beginning with 30 21 the effective date of the agreement to combine merged areas. 30 22 The bargaining shall be completed by March 15 prior to the 30 23 academic year in which the agreement to combine merged areas 30 24 becomes effective or within one hundred eighty days after the 30 25 organization of the acting board of the new combined merged 30 26 area, whichever is later. If a bargaining agreement was 30 27 already concluded in the former merged area which has the 30 28 collective bargaining agreement that is serving as the base 30 29 agreement for the new combined merged area, between the former 30 30 merged area board and the employees of the former merged area, 30 31 that agreement is void, unless the agreement contained 30 32 multiyear provisions affecting academic years subsequent to 30 33 the effective date of the agreement to form a combined merged 30 34 area. If the base collective bargaining agreement contains 30 35 multiyear provisions, the duration and effect of the agreement 31 1 shall be controlled by the terms of the agreement. The 31 2 provisions of the base agreement shall apply to the offering 31 3 of new contracts, or the continuation, modification, or 31 4 termination of existing contracts between the acting or new 31 5 board of the combined merged area and the combined employees 31 6 of the new combined merged area. 31 7 Sec. 29. NEW SECTION. 260C.49 RULES. 31 8 The department of education shall adopt rules and 31 9 definitions of terms necessary for the administration of this 31 10 chapter. The school budget review committee shall adopt rules 31 11 under chapter 17A to carry out section 260C.18B. 31 12 Sec. 30. Section 261.12, subsection 1, paragraph b, Code 31 13 Supplement 1995, is amended to read as follows: 31 14 b. For the fiscal year beginning July 1,19951996, and 31 15 for each following fiscal year,twothree thousandnine31 16hundredfifty dollars. 31 17 Sec. 31. Section 261.13, Code 1995, is amended to read as 31 18 follows: 31 19 261.13 ANNUAL GRANT. 31 20 A tuition grant may be made annually for both the fall and 31 21 spring semesters or the trimester equivalent. Payments under 31 22 the grant shall be allocated equally among the semesters or 31 23 trimesters and shall be paid at the beginning of each semester 31 24 or trimester upon certification by the accredited private 31 25 institution that the student is admitted and in attendance. 31 26 If the student discontinues attendance before the end of any 31 27 semester or trimester after receiving payment under the grant, 31 28 the entire amount of any refund due that student, up to the 31 29 amount of any payments made under the annual grant, shall be 31 30 paid by the accredited private institution to the state, and 31 31 the student shall pay the difference between the amount 31 32 refunded to the state and the grant amount received by the 31 33 student for the term to the commission, which shall use the 31 34 moneys paid by the student for purposes of awarding tuition 31 35 grants. The commission may use the collection for delinquent 32 1 loans system provided for in section 261.37 to collect funds 32 2 owed by an individual to the commission pursuant to this 32 3 section. 32 4 Sec. 32. Section 261.17, subsection 4, Code 1995, is 32 5 amended to read as follows: 32 6 4. A vocational-technical tuition grant shall be awarded 32 7 on an annual basis, requiring reapplication by the student for 32 8 each year. Payments under the grant shall be allocated 32 9 equally among the semesters or quarters of the year upon 32 10 certification by the institution that the student is in full- 32 11 time attendance in a vocational-technical or career option 32 12 program, as defined under rules of the department of 32 13 education. If the student discontinues attendance before the 32 14 end of any term after receiving payment of the grant, the 32 15 entire amount of any refund due that student, up to the amount 32 16 of any payments made under the annual grant, shall be paid by 32 17 the institution to the state, and the student shall pay the 32 18 difference between the amount refunded to the state and the 32 19 grant amount received by the student for the term to the 32 20 commission, which shall use the moneys paid by the student for 32 21 purposes of this section. The commission may use the 32 22 collection for delinquent loans system provided for in section 32 23 261.37 to collect funds owed by an individual to the 32 24 commission pursuant to this section. 32 25 Sec. 33. Section 261.25, subsection 1, Code Supplement 32 26 1995, is amended to read as follows: 32 27 1. There is appropriated from the general fund of the 32 28 state to the commission for each fiscal year the sum of 32 29thirty-fivethirty-seven millionsixnine hundredsixty-four32 30 sixty-five thousandseventhree hundredfiftyseventy dollars 32 31 for tuition grants. 32 32 Sec. 34. Section 261.48, unnumbered paragraph 4, Code 32 33 1995, is amended by striking the unnumbered paragraph. 32 34 Sec. 35. Section 261C.6, subsection 2, unnumbered 32 35 paragraph 2, Code 1995, is amended to read as follows: 33 1 A pupil is not eligible to enroll on a full-time basis in 33 2 an eligible postsecondary institution and receive payment for 33 3 all courses in which a student is enrolled.If an eligible33 4postsecondary institution is a community college established33 5under chapter 260C, the contact hours of a pupil for which a33 6tuition reimbursement amount is received are not contact hours33 7eligible for general aid under chapter 260D.33 8 Sec. 36. Section 262.9, subsection 4, Code Supplement 33 9 1995, is amended by striking the subsection and inserting in 33 10 lieu thereof the following: 33 11 4. Manage and control the property, both real and 33 12 personal, belonging to the institutions. 33 13 Sec. 37. Section 262.9, subsection 10, Code Supplement 33 14 1995, is amended by striking the subsection. 33 15 Sec. 38. Section 262.9, Code Supplement 1995, is amended 33 16 by adding the following new subsections: 33 17 NEW SUBSECTION. 30. By January 1 annually, submit a 33 18 report to the general assembly and the legislative fiscal 33 19 bureau on the facilities overhead use allowance and the amount 33 20 of building and equipment use allowances of the overall 33 21 indirect cost recovery on federally sponsored research 33 22 programs. The report shall include the individual 33 23 institutional policies of distribution of the federal 33 24 facilities overhead use allowance within each institution of 33 25 higher learning under the control of the board, and shall be 33 26 in a format agreed to by the board and the legislative fiscal 33 27 bureau. 33 28 NEW SUBSECTION. 31. Direct the institutions of higher 33 29 learning under the board to participate in the state library's 33 30 access plus program without reimbursement by the state 33 31 library. 33 32 Sec. 39. Section 262.34A, Code 1995, is amended to read as 33 33 follows: 33 34 262.34A BID REQUESTS. 33 35 The state board of regents shall request bids and proposals 34 1 for materials, products, supplies, provisions, and other 34 2 needed articles to be purchased at public expense, from Iowa 34 3 state industries as defined in section 904.802, subsection 2, 34 4 when the articles are available in the requested quantity and 34 5 at comparable prices and quality. The exceptions provided 34 6 under section 904.808, subsection 1, shall not apply to the 34 7 state board of regents. 34 8 Sec. 40. Section 262A.6A, subsection 1, Code 1995, is 34 9 amended by striking the subsection and inserting in lieu 34 10 thereof the following: 34 11 1. The board may issue bonds in an amount not exceeding 34 12 fifty percent of the amount of bonds authorized pursuant to 34 13 section 262A.4 in the form of capital appreciation bonds as 34 14 provided in this section, rather than the form prescribed in 34 15 sections 262A.5 and 262A.6. The capital appreciation bonds 34 16 shall be designed to be marketed primarily to Iowans to 34 17 facilitate savings for future higher education costs. 34 18 Sec. 41. Section 294A.25, subsections 7 and 8, Code 34 19 Supplement 1995, are amended to read as follows: 34 20 7. Commencing with the fiscal year beginning July 1,199334 21 1996, the amount of fifty thousand dollars for geography 34 22 alliance, fifty thousand dollars for the Iowa mathematics and 34 23 science coalition, seventy thousand dollars for gifted and 34 24 talented, andonethree hundredeightythousand dollars for a 34 25 management information system from additional funds 34 26 transferred from phase I to phase III. If funds available are 34 27 insufficient to fully fund the appropriation for a management 34 28 information system under this subsection, the amount 34 29 distributed for the management information system shall be 34 30 reduced to an amount equal to the available funds. 34 31 8. For the fiscal year beginning July 1,19951996, and 34 32 ending June 30, 1997, to the department of education from 34 33 phase III moneys the amount of one million two hundred fifty 34 34 thousand dollars shall be allocated to the child development 34 35 coordinating council established under chapter 256A for 35 1support for the operations of the new Iowa schools development35 2corporation and for school transformation design and35 3implementation projects administered by the corporationthe 35 4 purposes set out in section 279.51, subsection 2, and section 35 5 256A.3.Of the amount provided in this subsection, one35 6hundred fifty thousand dollars shall be used for the school35 7and community planning initiative.Moneys distributed as 35 8 provided in this subsection shall supplement, not supplant, 35 9 any other moneys appropriated for purposes of the child 35 10 development coordinating council. 35 11 Sec. 42. Section 303.5, subsection 2, Code 1995, is 35 12 amended by adding the following new paragraph: 35 13 NEW PARAGRAPH. c. Charge a reasonable fee to the state 35 14 department of transportation to recover the costs of providing 35 15 historic site evaluations required under federal law to be 35 16 conducted prior to or during road construction. Funds 35 17 generated by the state historical society pursuant to this 35 18 subsection are appropriated to and shall be used at the 35 19 direction of the state historical society to fulfill its 35 20 responsibilities as provided in this subchapter. 35 21 Sec. 43. Section 331.502, subsection 13, Code 1995, is 35 22 amended to read as follows: 35 23 13. Collect the costs relating to the treatment and care 35 24 of private patients at the state psychiatric hospital as 35 25 provided in sections 225.23,and 225.24and 225.35. 35 26 Sec. 44. REPEAL. 35 27 1. Sections 225.28, 225.35, 261.45, 261.52A, and 294.15, 35 28 Code 1995, are repealed. 35 29 2. Chapter 260D, Code and Code Supplement 1995, is 35 30 repealed. 35 31 Sec. 45. EFFECTIVE DATE. The unnumbered paragraph 35 32 relating to the creation of a dental hygienist program 35 33 provided for in section 5, subsection 15 of this Act, being 35 34 deemed of immediate importance, takes effect upon enactment. 35 35 Sec. 46. RETROACTIVE APPLICABILITY. Section 21 of this 36 1 Act, which amends section 257B.1A, subsections 2 and 3, is 36 2 retroactively applicable to July 1, 1995. The department of 36 3 revenue and finance shall adjust the fourth quarter transfer 36 4 of funds to the first in the nation in education fund and the 36 5 Connie Belin and Jacqueline N. Blank international center for 36 6 gifted and talented development, in accordance with section 36 7 257B.1A, to accurately reflect section 257B.1A as amended by 36 8 this Act. 36 9 Sec. 47. Sections 3, 6, 7, 11, and 46 of this Act and 36 10 section 44, subsection 2 of this Act, being deemed of 36 11 immediate importance, take effect upon enactment. 36 12 EXPLANATION 36 13 This bill makes appropriations for the 1996-1997 fiscal 36 14 year to the department of education, the college student aid 36 15 commission, the state board of regents, and the department of 36 16 cultural affairs. 36 17 The bill makes statutory changes as follows: 36 18 1. Replaces the funding provisions of chapter 260D, which 36 19 is repealed under this bill, with a provision that establishes 36 20 that funds appropriated specifically to the 15 community 36 21 colleges shall be allocated to the community colleges based 36 22 upon the distribution percentages used to distribute state 36 23 general financial aid for community colleges for the fiscal 36 24 year beginning July 1, 1995. Some of the language of chapter 36 25 260D is still appropriate for use in the Code, and conforming 36 26 changes, are also made. 36 27 2. Moves the authority to appoint the state librarian from 36 28 the commission of libraries to the director of the department 36 29 of education. The bill also provides that the department, 36 30 rather than the commission, is to receive and approve the 36 31 budget and unified plan of service submitted by the division 36 32 of libraries and information services. 36 33 3. Provides that the interest which the first in the 36 34 nation in education foundation receives as a match to the 36 35 contributions it receives is based upon the cash contributions 37 1 the foundation receives. 37 2 4. Provides that if a student who has received a tuition 37 3 grant or a vocational-technical grant and who discontinues 37 4 attendance before the end of any semester or trimester after 37 5 receiving payment under the grant, must pay the difference 37 6 between the amount refunded to the state and the grant amount 37 7 received for the term to the commission, which shall use the 37 8 moneys paid by the student to award the respective grant. The 37 9 commission is also allowed to utilize the collection for 37 10 delinquent loans system to collect the payments from the 37 11 students. 37 12 5. Strikes language relating to the purchase of inks and 37 13 starch-based plastics by the state board of regents and 37 14 language related to the publishing of pamphlets, bulletins, 37 15 and reports by the state board of regents. New subsection 30 37 16 requires the board to annually submit a report to the general 37 17 assembly and the legislative fiscal bureau related to the 37 18 facilities overhead use allowance and the amount of building 37 19 and equipment use allowances of the overall indirect cost 37 20 recovery on federally sponsored research programs. 37 21 6. Denies to the state board of regents certain exceptions 37 22 allowed to state departments and agencies from purchasing Iowa 37 23 state industries products. 37 24 7. Provides that the state board of regents may issue 37 25 bonds in an amount not exceeding 50 percent of the amount of 37 26 bonds authorized pursuant to section 262A.4 in the form of 37 27 capital appreciation bonds to be marketed primarily to Iowans 37 28 to facilitate savings for future higher education costs. 37 29 8. Provides for new distribution of educational excellence 37 30 funds to the child development coordinating council and for 37 31 the Iowa mathematics and science coalition. In addition, 37 32 subsection 7 provides that if funds are insufficient to fully 37 33 fund the distribution for the management information system, 37 34 the amount to be distributed is reduced to an amount equal to 37 35 the available funds. 38 1 9. Permits the state historical society to charge the 38 2 state department of transportation a historic site evaluation 38 3 fee and to keep the funds generated to fulfill its 38 4 responsibilities. 38 5 LSB 3309HA 76 38 6 kh/cf/24
