  1  1    Section 1.  Section 468.506, Code 1995, is amended to read
  1  2 as follows:
  1  3    468.506  ELIGIBILITY OF TRUSTEES.
  1  4    Each trustee shall be a citizen of the United States not
  1  5 less than eighteen years of age, and one of the following:
  1  6    1.  The bona fide owner of agricultural land in the
  1  7 election district for which the trustee is elected, and a
  1  8 resident of the county in which that district is located or of
  1  9 a county which is contiguous to or corners on that county.
  1 10    2.  The bona fide owner of nonagricultural land in the
  1 11 election district for which the trustee is elected, and a
  1 12 resident of that district.  This subsection applies only when
  1 13 the election district is wholly within the corporate limits of
  1 14 a city.
  1 15    3.  A stockholder of a family farm corporation as defined
  1 16 in section 9H.1, subsection 8, which owns land in the election
  1 17 district who is a resident of the county in which that
  1 18 district is located or of a county which is contiguous to or
  1 19 corners on that county for which the trustee is elected.
  1 20    4.  In a district which is a levee and drainage district
  1 21 which has eighty-five percent of its acreage within the
  1 22 corporate limits of a city and has been under the control of a
  1 23 city under subchapter II, part 3, a bona fide owner of
  1 24 benefited land in the district.  If the owner is a family farm
  1 25 corporation as defined by section 9H.1, subsection 8, a
  1 26 business corporation organized and existing under chapter 490
  1 27 or 491, or a partnership, a stockholder or officer authorized
  1 28 by the corporation or a general partner may be elected as a
  1 29 trustee of the district.  
  1 30                           EXPLANATION
  1 31    This bill eliminates the requirement that to be eligible to
  1 32 be elected as a trustee of a drainage or levee district, a
  1 33 bona fide owner of agricultural land located in the election
  1 34 district for which the trustee is elected shall be a resident
  1 35 of the county in which the drainage or levee district is
  2  1 located or of a county which is contiguous to the county.
  2  2    The bill also eliminates the requirement that to be
  2  3 eligible to be elected as a trustee of a drainage or levee
  2  4 district, a bona fide owner of nonagricultural land located in
  2  5 the election district for which the trustee is elected shall
  2  6 be a resident of the district.
  2  7    The bill further eliminates the requirement that to be
  2  8 eligible to be elected as a trustee of a drainage or levee
  2  9 district, a stockholder of a family farm corporation which
  2 10 owns land in the election district for which the trustee is
  2 11 elected shall be a resident of the county in which the
  2 12 drainage or levee district is located or of a county which is
  2 13 contiguous to the county.
