  1  1    Section 1.  Section 261C.4, Code 1995, is amended to read
  1  2 as follows:
  1  3    261C.4  AUTHORIZATION.
  1  4    An eligible pupil may make application to an eligible
  1  5 institution to allow the eligible pupil to enroll for academic
  1  6 or vocational-technical credit in a nonsectarian course
  1  7 offered at by that eligible institution.  The course may be
  1  8 offered at a location leased by the eligible institution from
  1  9 the board of directors of a school district.  A comparable
  1 10 course, as defined in rules made by the board of directors of
  1 11 the public school district, must not be offered by the school
  1 12 district or accredited nonpublic school which the pupil
  1 13 attends.  If an eligible institution accepts an eligible pupil
  1 14 for enrollment under this section, the institution shall send
  1 15 written notice to the pupil, the pupil's school district or
  1 16 accredited nonpublic school or the school for the deaf or the
  1 17 Iowa braille and sight saving school, and the department of
  1 18 education.  The notice shall list the course, the clock hours
  1 19 the pupil will be attending the course, and the number of
  1 20 hours of postsecondary academic or vocational-technical credit
  1 21 that the eligible pupil will receive from the eligible
  1 22 institution upon successful completion of the course.  
  1 23                           EXPLANATION
  1 24    This bill permits an eligible institution under the
  1 25 postsecondary enrollment options law to offer a course for an
  1 26 eligible pupil at a location leased by the eligible
  1 27 institution from the board of directors of a school district.
