PAG LIN 1 1 Section 1. NEW SECTION. 17A.21A FEDERAL FUNDING AND 1 2 PROGRAM CHANGES. 1 3 1. In addition to the requirements of section 17A.4, if an 1 4 agency proposes to adopt or adopts a rule on or after the 1 5 effective date of this Act for purposes of conforming to a 1 6 change in federal funding or in program requirements enacted 1 7 or implemented by the federal government after September 30, 1 8 1994, the rule adoption documents shall include in a clearly 1 9 identified manner the following information: 1 10 a. The funding provision or program to be changed and a 1 11 description of the change. 1 12 b. A citation to and description of the federal and state 1 13 legal basis authorizing the agency to make the change. 1 14 c. The agency's reasons for changing the funding provision 1 15 or program in the manner proposed or adopted. 1 16 d. An explanation of the supporting arguments for the 1 17 proposed or adopted change. 1 18 e. An explanation of the likely impacts resulting from the 1 19 change. 1 20 f. An explanation of the likely or actual areas of public 1 21 comment. 1 22 g. An explanation of the potential effects of the proposed 1 23 change on other state and local policies. 1 24 h. An explanation of alternatives considered and reasons 1 25 the alternatives were rejected. 1 26 i. An explanation of the potential fiscal and policy 1 27 effects of the change upon federal, state, and local 1 28 governmental bodies. 1 29 j. A description of the fiscal impact of the change 1 30 segregated by funding source. 1 31 k. A description of the agency's activities to conform 1 32 with the requirements of 1996 Iowa Acts, House File LSB 1 33 3608HV, if enacted. 1 34 2. If a majority of the members of the administrative 1 35 rules review committee determines that a proposed or adopted 2 1 rule is subject to this section and the accompanying 2 2 documentation does not comply with the information 2 3 requirements of this section, the proposed rule shall not take 2 4 effect and the adopted rule shall be void until the required 2 5 information is supplied to the committee. 2 6 3. The legislative council may appoint advisory bodies 2 7 consisting of members of the general assembly with specialized 2 8 public policy knowledge to consider proposed and adopted rules 2 9 described by this section in order to make recommendations to 2 10 the administrative rules review committee concerning possible 2 11 actions by the rules committee regarding the rules. The 2 12 recommendations may include but are not limited to a 2 13 recommendation for a delay, objection to, or referral of a 2 14 rule under section 17A.4 or 17A.8. The legislative council 2 15 shall authorize meeting days for an advisory body. An 2 16 advisory body appointed under this subsection shall have the 2 17 powers of a standing legislative committee under section 2.15 2 18 except for introduction of bills and resolutions, and shall be 2 19 considered as authorized to conduct investigations. Staffing 2 20 for the advisory bodies shall be provided by the legislative 2 21 service bureau and the legislative fiscal bureau. A 2 22 legislative member of an advisory body is eligible for per 2 23 diem and expenses under section 2.10, payable as a joint 2 24 legislative expense pursuant to section 2.12. 2 25 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 2 26 immediate importance, takes effect upon enactment. 2 27 EXPLANATION 2 28 This bill relates to state agency conformity with federal 2 29 funding changes. 2 30 The bill amends chapter 17A, the Iowa administrative 2 31 procedure Act, to apply certain requirements to an 2 32 administrative rule proposed or adopted by an agency on or 2 33 after the effective date of the bill for the purposes of 2 34 conforming to a change in federal funding or in program 2 35 requirements enacted or implemented after September 30, 1994. 3 1 Under the bill, the rule adoption documents for such a rule 3 2 must include certain specified information. 3 3 If a majority of the administrative rules review committee 3 4 determines that a proposed or adopted rule subject to the bill 3 5 does not comply with the information requirements, a proposed 3 6 rule shall not take effect and an adopted rule is void until 3 7 the required information is supplied to the committee. 3 8 The legislative council may appoint advisory bodies of 3 9 legislators with specialized public policy knowledge to 3 10 consider proposed and adopted administrative rules which are 3 11 subject to the bill. An advisory body is authorized to make 3 12 recommendations to the administrative rules review committee. 3 13 An advisory body has the powers of a standing committee of the 3 14 general assembly except for introduction of bills and 3 15 resolutions. Staffing is to be provided by the legislative 3 16 service and fiscal bureaus.
