  1  1    Section 1.  Section 175.3, subsection 7, Code 1995, is
  1  2 amended to read as follows:
  1  3    7.  The appointed members shall elect a chairperson and
  1  4 vice chairperson annually, and other officers as they
  1  5 determine, but the executive director shall serve as secretary
  1  6 to the authority.  The chairperson and vice chairperson shall
  1  7 serve on the selection and tenure committee as provided in
  1  8 section 175.7.
  1  9    Sec. 2.  Section 175.7, subsection 1, Code 1995, is amended
  1 10 to read as follows:
  1 11    1.  The secretary of agriculture shall appoint an executive
  1 12 director of the authority, who shall be appointed by a
  1 13 selection and tenure committee which shall consist of the
  1 14 secretary of agriculture, and the chairperson and vice
  1 15 chairperson of the board established pursuant to section
  1 16 175.3, or their designees.  The executive director shall serve
  1 17 at the pleasure of the secretary committee.  The votes of
  1 18 three members of the committee are necessary for any
  1 19 substantive action taken by the committee, except that two
  1 20 members may take a substantive action, if the secretary has a
  1 21 conflict of interest.  If a member other than the secretary
  1 22 has a conflict of interest, the board shall appoint a
  1 23 substitute member of the committee from the appointed members
  1 24 of the board for the duration of the conflict of interest.
  1 25 The executive director shall be selected primarily for
  1 26 administrative ability and knowledge in the field, without
  1 27 regard to political affiliation.
  1 28    1A.  The executive director shall not, directly or
  1 29 indirectly, exert influence to induce any other officers or
  1 30 employees of the state to adopt a political view, or to favor
  1 31 a political candidate for office.  
  1 32                           EXPLANATION
  1 33    Section 175.7, provides that the executive director of
  1 34 agricultural development authority is appointed by the
  1 35 secretary of agriculture and serves at the pleasure of the
  2  1 secretary.  This bill provides that the executive director
  2  2 shall be appointed by a selection and tenure committee which
  2  3 consists of the secretary of agriculture, and the chairperson
  2  4 and vice chairperson of the board established to administer
  2  5 the authority, or their designees.  The bill provides that the
  2  6 executive director serves at the pleasure of the committee.
  2  7 The bill requires that a vote of all three members is
  2  8 necessary for a substantive action to be taken by the
  2  9 committee.  The bill provides for committee action if a
  2 10 committee member has a conflict of interest.
