  1  1    Section 1.  Section 8.56, subsection 4, paragraph b, Code
  1  2 Supplement 1995, is amended to read as follows:
  1  3    b.  In addition to the requirements of paragraph "a", an
  1  4 appropriation shall not be made from the cash reserve fund
  1  5 which would cause the fund's balance to be less than three
  1  6 percent of the adjusted revenue estimate for the year for
  1  7 which the appropriation is made unless the bill or joint
  1  8 resolution containing the appropriation is approved by vote of
  1  9 at least three-fifths of the members of both chambers of the
  1 10 general assembly and is signed by the governor.  
  1 11                           EXPLANATION
  1 12    This bill revises a requirement for the general assembly's
  1 13 approval of an appropriation from the cash reserve fund.
  1 14 Under current law, an appropriation which would cause the
  1 15 balance in the fund to be less than 3 percent of the adjusted
  1 16 revenue estimate for the general fund of the state for the
  1 17 year in which the appropriation is made requires approval of
  1 18 three-fifths of the members of the general assembly.  The bill
  1 19 would require the three-fifths majority vote for any
  1 20 appropriation from the fund.
