PAG LIN 1 1 Section 1. Section 618.11, Code 1995, is amended to read 1 2 as follows: 1 3 618.11 FEES FOR PUBLICATION. 1 4 The compensation, when not otherwise fixed, for the 1 5 publication in a newspaper of any notice, order, citation, or 1 6 other publication required or allowed by law,shall not exceed1 7twenty-six cents for one insertion, and seventeen cents for1 8each subsequent insertion, for each line of eight-point type1 9two inches in length, or its equivalentshall be as 1 10 established by the superintendent of printing who shall 1 11 annually review, and adjust when necessary, compensation rates 1 12 to reflect changes in economic conditions within the newspaper 1 13 industry and the general economy of the state.Publication of1 14matter which may be photographically reproduced for printing1 15instead of typeset shall be compensated at a rate not to1 16exceed the lowest available earned rate for any similar1 17advertising matter. Statements of itemized financial and1 18other like columnar matter shall be published in tabular form1 19without additional compensation. In case of controversy or1 20doubt regarding measurements, style, manner, or form, the1 21controversy shall be referred to the executive council, and1 22its decision is final.Prior to establishing or adjusting any 1 23 rate the superintendent of printing shall consult with 1 24 representatives of the daily and weekly newspaper industry and 1 25 with representatives of affected units of local government. 1 26 EXPLANATION 1 27 The bill removes the set statutory rate of compensation for 1 28 publication of notices for which rates are not otherwise set 1 29 by statute and requires that a rate be established by the 1 30 superintendent of printing after consultation with 1 31 representatives of affected local governmental entities and 1 32 the newspaper industry. Rates are required to be reviewed 1 33 annually, with adjustment made by the superintendent of 1 34 printing if necessary to more accurately reflect current 1 35 economic conditions. 2 1 LSB 3224HC 76 2 2 rn/cf/24
