1 1 Section 1. Section 135C.2, Code Supplement 1995, is
1 2 amended by adding the following new subsection:
1 3 NEW SUBSECTION. 7. The rules adopted by the department
1 4 regarding nursing facilities shall include recognition, in
1 5 lieu of inspection by the department, of comparable
1 6 inspections and inspection findings of the joint commission on
1 7 accreditation of health care organizations, if the department
1 8 is provided with copies of all requested materials relating to
1 9 the inspection process.
1 10 Sec. 2. Section 135C.6, Code 1995, is amended by adding
1 11 the following new subsection:
1 12 NEW SUBSECTION. 9. Notwithstanding section 135C.9,
1 13 nursing facilities which are accredited by the joint
1 14 commission on accreditation of health care organizations shall
1 15 be licensed without inspection by the department.
1 16 EXPLANATION
1 17 This bill provides for adoption of rules regarding the
1 18 licensure of nursing facilities, without inspection by the
1 19 department of inspections and appeals, if the nursing facility
1 20 is accredited by inspection by the joint commission on
1 21 accreditation of health care organizations and if all required
1 22 materials regarding inspection are provided to the department.
