  1  1    Section 1.  Section 321.177, subsection 1, Code Supplement
  1  2 1995, is amended to read as follows:
  1  3    1.  To any person who is under the age of eighteen years,
  1  4 without the person's first having successfully completed an
  1  5 approved driver education course, in which case, the minimum
  1  6 age is sixteen years.  However, the department may issue a
  1  7 driver's license to certain minors as provided in section
  1  8 321.194, an instruction permit as provided in section 321.180,
  1  9 subsection 1, or a driver's license restricted to motorized
  1 10 bicycles as provided in section 321.189, subsection 8.
  1 11    Sec. 2.  Section 321.178, subsection 2, Code 1995, is
  1 12 amended by striking the subsection.
  1 13    Sec. 3.  Section 321.178, subsection 3, paragraph b,
  1 14 subparagraph (4), Code 1995, is amended to read as follows:
  1 15    (4)  The minor must pass the written and driving skills
  1 16 tests as required by the department, but is not required to.
  1 17 In addition, the minor shall have taken successfully completed
  1 18 a driver's state-approved driver education class course in
  1 19 Iowa or the prior state of residence, except as provided under
  1 20 section 321.178, unnumbered paragraph 6.
  1 21    Sec. 4.  Section 321.194, subsection 1, unnumbered
  1 22 paragraph 1, Code 1995, is amended to read as follows:
  1 23    Upon certification of a special need by the school board or
  1 24 the superintendent of the applicant's school, the department
  1 25 may issue a class C or M driver's license to a person between
  1 26 the ages of fourteen and eighteen years who successfully
  1 27 completes an approved driver education course.  However, the
  1 28 completion of a course is not required if the applicant
  1 29 demonstrates to the satisfaction of the department that
  1 30 completion of the course would impose a hardship upon the
  1 31 applicant.  The department shall adopt rules defining the term
  1 32 "hardship" and establish procedures for the demonstration and
  1 33 determination of when completion of the course would impose a
  1 34 hardship upon an applicant.  
  1 35                           EXPLANATION
  2  1    This bill eliminates provisions that permit a person
  2  2 between the ages of 14 and 18 to hold a driver's license
  2  3 without having successfully completed an approved driver
  2  4 education course.  Current Code permits the following
  2  5 exemptions to the course requirement:  (1) for applicants
  2  6 between the ages of 14 and 18 for special minors' licenses for
  2  7 traveling to and from school if the applicant demonstrates
  2  8 that completion of the course would impose a hardship upon the
  2  9 applicant, (2) to a person between the ages of 16 and 18 who
  2 10 is not in attendance at school or who is in attendance in a
  2 11 public or private school where a course is unavailable, for
  2 12 purposes of travel to and from work, to transport dependents
  2 13 to and from temporary care facilities, or to maintain
  2 14 employment, and (3) to a person who is 16 or 17 years of age
  2 15 and who has driven under a valid driver's license issued in
  2 16 another state for one year.
