PAG LIN 1 1 Section 1. Section 321L.5, subsection 3, paragraph b, Code 1 2 1995, is amended to read as follows: 1 3 b. An entity providing off-street nonresidential public 1 4 parking facilities shall review the utilization of existing 1 5 handicapped parking spaces for a one-month period not less 1 6 than once every twelve months. If upon review, the average 1 7 occupancy rate for handicapped parking spaces in a facility 1 8 exceeds sixty percent during normal business hours, the entity 1 9 shall provide additional handicapped parking spaces as needed. 1 10 Notwithstanding paragraph "a", if upon review a school 1 11 district finds that less than twenty-five percent of the 1 12 existing handicapped parking spaces are being used during 1 13 normal business hours and the location of parking spaces, 1 14 other than handicapped parking spaces, poses a significant 1 15 risk to the health or safety of the students, the school 1 16 district may provide for fewer handicapped spaces, as deemed 1 17 appropriate by the school district. 1 18 Sec. 2. EFFECTIVE DATE. This Act, being deemed of 1 19 immediate importance, takes effect upon enactment. 1 20 EXPLANATION 1 21 This bill allows a school district to designate fewer 1 22 handicapped parking spaces, as the school district deems 1 23 appropriate, if existing handicapped parking spaces are being 1 24 used less than 25 percent of the time during normal business 1 25 hours and the location of other parking spaces poses a 1 26 significant risk to the health or safety of the students. 1 27 This bill is effective upon enactment. 1 28 LSB 3265HC 76 1 29 js/jw/5
