  1  1    Section 1.  Section 312.2, subsection 18, Code 1995, is
  1  2 amended by striking the subsection.
  1  3    Sec. 2.  Section 455A.19, subsection 1, unnumbered
  1  4 paragraph 1, Code Supplement 1995, is amended to read as
  1  5 follows:
  1  6    Upon receipt of any revenue, the director shall deposit the
  1  7 moneys in the Iowa resources enhancement and protection fund
  1  8 created pursuant to section 455A.18.  The first Prior to the
  1  9 distribution of moneys in accordance with this section, three
  1 10 hundred fifty thousand dollars of the funds received for
  1 11 deposit in the fund annually shall be allocated annually to
  1 12 the conservation education board for the purposes specified in
  1 13 section 256.34.  One, one million dollars shall be allocated
  1 14 annually to the state department of transportation for the
  1 15 purpose of acquiring, constructing, and improving recreational
  1 16 trails within the state in accordance with chapter 465B, and
  1 17 one percent of the remaining revenue receipts shall be
  1 18 deducted and transferred to the administration fund provided
  1 19 for in section 456A.17.  All of the remaining receipts shall
  1 20 be allocated to the following accounts:
  1 21    Sec. 3.  Section 312.2A, Code 1995, is repealed.  
  1 22                           EXPLANATION
  1 23    This bill eliminates an annual appropriation of $1,000,000
  1 24 from the use tax prior to it being credited to the road use
  1 25 tax fund for recreational trails.  Instead, the bill
  1 26 appropriates $1,000,000 from the resource enhancement and
  1 27 protection fund for recreational trails.  The money is
  1 28 appropriated on an annual basis to the state department of
  1 29 transportation for the purpose of acquiring, constructing, and
  1 30 improving recreational trails within the state in accordance
  1 31 with chapter 465B.  The repeal of section 312.2A is a
  1 32 technical amendment.  Section 312.2A applied only to a
  1 33 specific grant of money and an appropriation made for fiscal
  1 34 year 1989.
