1 1 Section 1. Section 96.19, subsection 18, paragraph a,
1 2 subparagraph (6), subparagraph subdivision (g), Code
1 3 Supplement 1995, is amended to read as follows:
1 4 (g) In the employ of a governmental entity, if such
1 5 service is performed by an individual in the exercise of the
1 6 individual's duties as an elected official; as a member of a
1 7 legislative body, as a session-only employee of the general
1 8 assembly, or a member of the judiciary, of a state or
1 9 political subdivision; as a member of the state national guard
1 10 or air national guard; as an employee serving on a temporary
1 11 basis in case of fire, storm, snow, earthquake, flood, or
1 12 similar emergency; or in a position which, pursuant to the
1 13 state law, is designated as a major nontenured policymaking or
1 14 advisory position, or a policymaking or advisory position
1 15 which ordinarily does not require duties of more than eight
1 16 hours per week. For purposes of this subsection, "session-
1 17 only employee of the general assembly" means an individual
1 18 employed by the general assembly who provides service and
1 19 receives wages for that service only during the period of time
1 20 that the general assembly is in session or shortly before or
1 21 after the period of time that the general assembly is in
1 22 session.
1 23 EXPLANATION
1 24 This bill provides that the service provided by individuals
1 25 who are session-only employees of the general assembly does
1 26 not constitute employment for purposes of being eligible for
1 27 unemployment benefits. The bill defines session-only
1 28 employees as individuals who work and earn wages only when the
1 29 legislature is in session or shortly before and after the
1 30 session.
