  1  1    Section 1.  PERSONS WITH MENTAL RETARDATION &endash; DEFINITION.
  1  2 The mental health and mental retardation commission shall
  1  3 adopt rules regarding the standards for providers of services
  1  4 to persons with mental illness, mental retardation, and
  1  5 developmental disabilities which define persons with mental
  1  6 retardation to include all of the following criteria:
  1  7    1.  A person is presumed to be a person with mental
  1  8 retardation if the person is tested and receives an
  1  9 intelligence quotient of seventy or less.
  1 10    2.  A person who is tested and receives an intelligence
  1 11 quotient which is greater than seventy is presumed not to be a
  1 12 person with mental retardation.
  1 13    3.  The presumptions established under subsections 1 and 2
  1 14 are rebuttable.
  1 15    4.  A person disputing the presumption under subsection 1
  1 16 or 2 may, at the person's own expense, secure independent
  1 17 intelligence quotient testing to rebut the presumption.  
  1 18                           EXPLANATION
  1 19    This bill directs the mental health and mental retardation
  1 20 commission to adopt rules regarding the standards for
  1 21 providers of services to persons with mental illness, mental
  1 22 retardation, and developmental disabilities which define
  1 23 persons with mental retardation.  The bill provides parameters
  1 24 for the defining of persons with mental retardation based upon
  1 25 the person's intelligence quotient (IQ) level, and provides a
  1 26 presumption that a person is a person with mental retardation
  1 27 if the person's IQ level is 70 or less, and a presumption that
  1 28 a person is not a person with mental retardation if the
  1 29 person's IQ level is greater than 70.  The bill provides that
  1 30 the presumptions are rebuttable and that a person disputing
  1 31 either presumption may, at the person's own expense, secure
  1 32 independent IQ testing to rebut the presumption.
