1 1 Section 1. NEW SECTION. 400.3A PUBLIC SAFETY EMPLOYEES
1 2 UNDER CIVIL SERVICE &endash; PRIVATIZATION BY REFERENDUM.
1 3 1. As used in this section, "public safety employee" means
1 4 a city employee performing police protection services, fire
1 5 protection services, or emergency medical services.
1 6 2. If a city employs public safety employees under civil
1 7 service pursuant to this chapter, the city shall not contract
1 8 with or grant a franchise to private providers of public
1 9 safety services without approval of the city electorate. If a
1 10 city council wishes to abolish a city public safety department
1 11 or service provided by employees under civil service pursuant
1 12 to this chapter, the council shall adopt an ordinance
1 13 abolishing the public safety department or service and propose
1 14 to contract with or to grant a franchise to a private person
1 15 for the performance of the public safety services. However,
1 16 the ordinance shall not take effect until it has been
1 17 submitted to the voters at a regular city election and
1 18 approved by a majority of the voters voting on the proposal at
1 19 the election. The ordinance shall be published before the
1 20 election in the same manner as provided in section 400.3.
1 21 EXPLANATION
1 22 This bill requires a city which employs public safety
1 23 employees (police, fire fighter, or emergency medical service)
1 24 under civil service to obtain voter approval of any contract
1 25 or franchise agreement to have these public safety services
1 26 provided by private persons.
