1 1 Section 1. Section 123.49, subsection 2, Code 1995, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. l. Sell or dispense at retail a
1 4 refrigerated or chilled alcoholic beverage for consumption off
1 5 the premises. All alcoholic beverages for sale at retail
1 6 shall be stored and sold at room temperature. The
1 7 administrator shall adopt rules pursuant to chapter 17A
1 8 prescribing the room temperature for licensees and permittees
1 9 selling alcoholic beverages at retail for consumption off the
1 10 premises.
1 11 EXPLANATION
1 12 This bill prohibits the sale at retail or dispensing of a
1 13 refrigerated or chilled alcoholic beverage for consumption off
1 14 the premises by a person holding a liquor control license or
1 15 retail wine or beer permit. The bill also provides that all
1 16 alcoholic beverages for sale at retail shall be stored and
1 17 sold at room temperature as prescribed by rule of the
1 18 administrator of the alcoholic beverages division. Violators
1 19 are guilty of a simple misdemeanor. Furthermore, violators
1 20 may have their licenses or permits suspended or revoked.
