1 1 Section 1. Section 455D.3, Code 1995, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5. MORATORIUM ON FIFTY PERCENT GOAL.
1 4 Notwithstanding subsection 1, the fifty percent waste stream
1 5 reduction and recycling goal shall not be enforced against any
1 6 planning area which operates a sanitary disposal project as
1 7 defined in section 455B.301 until the planning area has the
1 8 legal right to require that all solid waste generated within
1 9 its boundaries be disposed of only in sanitary disposal
1 10 projects operated by the planning area. Such right shall be
1 11 deemed to have arisen when the United States supreme court
1 12 determines that flow-control restrictions are constitutional
1 13 and otherwise permissible. A planning area under this
1 14 subsection shall comply with the fifty percent waste stream
1 15 reduction and recycling goal within five years after attaining
1 16 the right to impose flow-control restrictions.
1 17 EXPLANATION
1 18 This bill provides that a planning area is not required to
1 19 comply with the 50 percent waste stream reduction and
1 20 recycling goal until the United States supreme court grants
1 21 the right to impose flow-control restrictions. Flow-control
1 22 restrictions would allow a planning area the right to require
1 23 that all waste generated within the planning area's boundaries
1 24 be disposed of only in sanitary disposal projects operated by
1 25 the planning area. The bill provides that within five years
1 26 of being granted the right to impose flow-control restrictions
1 27 a planning area must meet the 50 percent goal.
