  1  1    Section 1.  NEW SECTION.  331.325  CONTROL AND CARE OF
  1  2 TOWNSHIP CEMETERIES AND ABANDONED CEMETERIES &endash; CEMETERY
  1  3 COMMISSION.
  1  4    1.  A county board of supervisors, on its own motion or
  1  5 upon receipt of a petition meeting the requirements of section
  1  6 331.306, may adopt an ordinance assuming jurisdiction and
  1  7 control of the township cemeteries and abandoned cemeteries in
  1  8 the county.  If an ordinance is adopted as provided in this
  1  9 subsection, the board shall exercise the powers and duties
  1 10 relating to the establishment, maintenance, and repair of
  1 11 cemeteries in the same manner as provided for township
  1 12 trustees in sections 359.28 through 359.41.
  1 13    2.  In lieu of management of the cemeteries, the board of
  1 14 supervisors may create, by ordinance, a cemetery commission to
  1 15 assume jurisdiction and management of the township and
  1 16 abandoned cemeteries in the county.  The ordinance shall
  1 17 specify the number of commissioners, the appointing authority,
  1 18 the term of office, officers, employees, organizational
  1 19 matters, rules of procedure, compensation and expenses, and
  1 20 other matters deemed pertinent by the board.  The board may
  1 21 delegate any power or duty related to cemeteries which may
  1 22 otherwise be exercised by township trustees in sections 359.28
  1 23 through 359.41 to the cemetery commission except that the
  1 24 board shall retain the power to approve or disapprove any tax
  1 25 levy certified by the cemetery commission.
  1 26    Sec. 2.  NEW SECTION.  359.2  COUNTY ASSUMPTION OF CEMETERY
  1 27 DUTIES.
  1 28    If the county board of supervisors assumes the jurisdiction
  1 29 and management of township cemeteries and abandoned cemeteries
  1 30 as provided in section 331.325, the township trustees remain
  1 31 responsible for the buildings and public grounds, excluding
  1 32 cemeteries, as provided in sections 359.28 through 359.41, and
  1 33 may levy taxes pursuant to section 359.30 for those purposes.  
  1 34                           EXPLANATION
  1 35    This bill authorizes the board of supervisors of a county,
  2  1 by county ordinance, to assume the control and management of
  2  2 township cemeteries and abandoned cemeteries in the county and
  2  3 exercise all of those powers and duties otherwise assigned to
  2  4 the township trustees in sections 359.28 through 359.41.  The
  2  5 board of supervisors may also appoint a cemetery commission
  2  6 and delegate the powers and duties relating to cemeteries to
  2  7 the cemetery commission.  The board of supervisors shall
  2  8 retain the power to approve or disapprove tax levies certified
  2  9 by the cemetery commission.
